Absent: Commissioner Fountain. LIQUOR LICENSE - Commissioner Sharp moved the application of Q. B. Bush for a Special Events SPECIAL EVENT Liquor License, to be held November 4 and 5, 1959, at the Forward Corporation, 413 Jackson, be approved on the basis of favorably police report and the Forward Corp. Supervisor of License and Revenue authorized to issue the license. Approved Motion seconded by Commissioner Whipple and carried by the following vote: Commissioners Elwell, Sharp, Whipple and His Honor Mayor Gragson voting aye; noes; none. Absent: Commissioner Fountain. VACATION VAC-6-59 The Commission considered the petition of Charleston Heights, Inc., L. M. Intersection of Laule, Ernest A. Becker, Jay C. Casada and Eva M. Casada, for the vacation of Alta Drive & property generally described as a portion of Decatur Boulevard at Alta Drive. Decatur Blvd. This involved two small parcels at the intersection of Decatur and Alta and there were no utilities involved. Approved Public Hearing Commissioner Whipple moved the aforementioned petition for the vacation of December 16, 1959 property generally described as a portion of Decatur Boulevard at Alta Drive be approved as recommended by the Planning Commission; and public hearing set for 7:30 P.M., December 16, 1959, in the Council Chambers of the City Hall. Motion seconded by Commissioner Whipple and carried by the following vote: Commissioners Elwell, Sharp, Whipple and His Honor Mayor Gragson voting aye; noes, none. Absent: Commissioner Fountain. VACATION VAC-7-59 The Commission considered the petition of Val Bissonnette, et al, for the vacation Block 4, Biltmore of property described as the easterly 5' of Lot 5 and the westerly 5' Addition Annex #3 of Lot 6, Block 4 of Biltmore Addition Annex No. 3, This involved an easement which was not needed for utilities. Approved Public Hearing Commissioner Sharp moved the aforementioned petition for the vacation of December 16, 1959 property described as the easterly 5' of Lot 5 and the westerly 5' of Lot 6, Block 4 of Biltmore Addition Annex No. 3 be approved as recommended by the Planning Commission and public hearing set for 7:30 P.M., December 16, 1959, in the Council Chambers of the City Hall. Motion seconded by Commissioner Whipple and carried by the following vote: Commissioners Elwell, Sharp, Whipple and His Honor Mayor Gragson voting aye; noes, none. Absent: Commissioner Fountain. VARIANCE V-15-59 The Commission considered the application of Ben Taylor for a variance to Ben Taylor replace an existing non-conforming dwelling with a new one at 707 Jackson Avenue, generally located at the southwest corner of Jackson Avenue and "G" Denied Street, legally described as Lot 7, Block 28, HFM & M Addition, save and except the east 40' of the south 50' in an R-3 zone. Denial was recommended by the Board of Zoning Adjustment. This application was reviewed by the Urban Renewal Committee, who also recommended denial. This property was located almost adjacent to the "Madison School" Project area; furthermore; the property was too small and the existing buildings were nonconforming. If the existing buildings were removed; a new house could be built on the property without special permission. There were no protests. 11-4-59
