Re: Transfer of Water Shop Well Appropriation from Well No. 1 to 1 n Las Vegas, Nevada November 7, 1953 Mr. E. E. Bennett: With reference to the above entitled matter, I trans­mit herewith a newspaper clipping containing notice of our application for change of point of diversion, which you will note was published October 5, 12, 26, and November 2. It is my understanding that the State Engineer is now in a position of acting upon our application unless protests to the same have been filed and he deems a hearing necessary* I am not advised of any protests and, therefore, assume he can now approve the application and issue a permit to appropriate water at the new point of diversion. In my letter to Mr. Shamberger of August 3, 1953, copy to you, I advised him that we did not wish a permit to be issued until after new distribution facilities in the shop grounds have been completed so that water can be delivered from the new point of diversion to the railroad facilities. I requested Mr. Shamberger to withhold further proceedings until such time as we request that the permit be issued. On April 28, 1953, you advised me that Work Order 5294 had been issued and you asked Mr. Smith to keep you advised of the progress of the work and probable date of completion. Inasmuch as it now appears that we can complete the proposed transfer, please advise me when you wish this to be done. CALVIN M, CORY CMC:lb
