Hammill) Beferring to your letter August 7 ,^1963, and Hr, Grooms's letter September 11/ relative unauthorized u»® of ester by Mr. Cy Boueh fro® pipe line serving Arden* Mevada; The unauthorized connection to the pipe line by Mr. Boueh is but a short distance fro® connection requested by Jese Jfauregui, authorized by work Order 3-5203 and covered by Contract Ml® If. 33^9, both of which were cancelled and the connection never made. --- — I can find nothing in my files to indicate our legal obligation as to furnishing water to individuals on whose property the Arden pipe line crosses. If Mr. Eouoh has purchased the property fro® Mr. Jauregui, it might be advisable to offer him a water connection and sell him water under the same terms and conditions as the proposed water connection and sale of water to Mr. Jauregui was to have been accomplished. If it Is your view that we have no legal obligation to allow Mr. Boueh to secure water from this pipe line, it might be advisable to advise him {as other applicants have been advised) that due to the deteriorated condition of tho pipe line, additional connections oannot bo made. Before proceeding further In the matter, would appreciate your recommendations and advice as to how we should proceed, l.e., offering him a connection and sale of water to him on the basis offered Mr. Jose Jauregui or, if we are not legally committed, to inform Mr. touch that there is no surplus water available from the line at this time and that his further use of the unauthorized connection to the pipe line must be terminated.
