SECTION 2. A charge shall be made for the restoration of City streets to their original condition after excavation, in accordance with City specifications for sewer, water, or gas connections as provided in the following schedule: (1) Gravel Surface Streets $ .25 per sq. ft. (2) Asphaltic Surface Streets .80 per sq. ft. (3) Concrete Sidewalk .80 per sq. ft. (4) Concrete Curb and Gutter 1.65 per lineal ft. (5) Travel Cost 4.00 SECTION 3. The permit, inspection, and service fees provided in this Ordinance shall be paid to the City Clerk of the City of Las Vegas before any work shall be done; provided, however that in the event it is found more practical by the Engineering Department in any case to require the work to be done first, the provisions of this Ordinance may be waived until after completion. SECTION 4. If any person, partnership, corporation, association, or others violate the provisions of this Ordinance, such party, or parties, shall be guilty of a misdemeanor, and shall upon conviction be punished by a fine of not more than five hundred dollars ($500.00), and/or six months in the City Jail. SECTION 5. If any one or more sections, sentences, clauses, or parts of this Ordinance shall, for any reason, be questioned or be held invalid such judgement shall not affect, impair or invalidate the remaining provisions of this Ordinance, but shall be confined in its operation to the specific sections, sentences, clauses, or parts of this Ordinance so held unconstitutional and invalid, and the inapplicability and invalidity of any section, sentence, clause or part of this Ordinance, in any one or more instances shall not affect or prejudice in any way the applicability and validity of this Ordinance in any other instances. SECTION 6. The City Clerk and Clerk of the Board of Commissioners of the City of Las Vegas shall cause this Ordinance to be published once a week for two successive weeks immediately following its final reading and adoption, in the Las Vegas Sun, a daily newspaper published in said City, and this Ordinance shall become effective immediately following the second publication hereof.
