machines, protesting against the rates charged by the Las Vegas Land and Water Company under its Rate No. 21 as indicated on Orig­inal Sheet P.S.C. No. 3 of the Company's schedule of rates which became effective September 1, 1951 by order of the Commission in I and S Docket No. 127. After a study of these protests it appeared to the Commis­sion that probable cause existed for the filing of the complaints and it was therefore ordered that in accordance with Public Service Commission law the matter be set down for hearing in order that every interested party might appear and be heard. Notice was given in the press and individually to each of the protestants and the Company that a hearing would be held on October 9, 1952, in the City Hall at Las Vegas, Nevada. Hie record as made at that hearing and the records of the Commission indicate that in August of 1931 the Commission ordered a schedule of rates entitled "Commission Rate" to be placed in effect as of September 30, 1931. This schedule indicated the fol­lowing rates for "Cooling water for refrigerating machines": Present Proposed Commission Rate Rate Rate " 1/2 ton machine, or less... -- $1.00 $2.00(monthly) Between 1/2 and 1 ton machine — 2.00 2.50 " For each ton over 1 ton.... -- 1.00 1.00 " Protests by the various people indicate that many of the cooling devices having as their basis refrigeration machinery had been placed in use and service paid for under the flat rates as in­dicated above.
