A G R E E M E N T NOW, THEREFORE, THIS AGREEMENT WITNESSETH: ARTICLE I . Subdivider agrees: 1. To advance and pay to the Company at the time of the execution of this agreement the sum of $3,368.75, being the agreed upon value of the pipe. 2. To furnish at its own expense, necessary material and fit­tings for the construction of the said pipe line, and to construct, or cause to be constructed, the said pipe line under the supervision, of the company and in a manner satisfactory to the company, and to commence said construction upon the arrival at Las Vegas of the necessary parts, and to complete said construction with reasonable diligence. All Joints shall be cement joints and the said pipe line shall have at least 36 inches of covering. The Installation shall be subject to approval and acceptance by a duly authorized representative of the company. 3. To deliver to the company, upon completion of the said pipe line, a bill of sale of the said pipe line, free and clear of all Hens and encumbrances, together with a detailed statement of the cost thereof, and to deliver to the company easements satisfactory in form, for that portion of said pipe line constructed by the Subdivider in other than dedicated - 2 - A S S '
