I L Los Angeles, Oct. 20, 1909. Mr. A. S, Halsted, General Attorney, City. Dear Sir;- •I enclose herewith letter from Mr. A. P. Kichols of Pomona, attorney for Hr. G. S. Phillips, in regard to negotiations I have been having with Mr. Phillips looking toward the^acquiring by our company of the right to use water from a Bpring on M r . Phillips Ranch near Spadra . The water from the spring is of good quality and of sufficient elevation above our track to fill a ta;k by gravitation and .it seems to be in every way a desirable acquisition by our company . The difficulty which- is in the way is in getting the water from the spring to our track.' ? There is a tract of land intervening which belongs to a third party, Mr. Spaulding, on which the spring water is now flowing. The water has been used by Mr . Spaulding for operating machinery at his quarry simply by pemission of Mr. Phillips and Mr. Phillips fears the possibility of Mr. Spaulding acquiring a prescriptive right to this water if he is allowed to continue the use of it . be possible for us to condemn a right of way for a pipe line from the spring to our.track in case we should buy a water right from the spring . a survey and find it is not practicable to convey water from the spring to our track without running over the Spaulding land . ‘ company as yet as I wanted to get the details worked up to find out if the proposition could be handled profitably to us . Will you kindly advise what the legal status of the matter is as to getting water across the Spaulding land to our track .
