At a recessed regular meeting of the Board of City Commissioners of the City of Las Vegas, Clark County, Nevada, held on the 26th day of January, 1929, at the hour of 7:30 P. M. PRESENT: His Honor the Mayor, J. F. Hesse, Commissioners O. J. Smith, W. B. Mundy, W. C. German, together with the City Attorney, Clerk and Engineer for the City. ABSENT: Commissioner Roy Neagle. Meeting called to order by the Mayor. Upon motion of Commissioner Smith, seconded by Commissioner Mundy, the following Preambles and Resolutions were duly adopted: Whereas a suit has been commenced in the District Court of the Tenth District of the State of Nevada, in and for the County of Clark, entitled STATE OF NEVADA, EX REL, F. E. MATZDORF, W. H. ELWELL, C. A. BRYANT, J. J. CURTIS, and JOE LARAVEY, Realtors, vs. NO. 1969. WILLIAM L. SCOTT, CLERK OF THE CITY OF LAS VEGAS, NEVADA: J. F. HESSE, MAYOR, W. B. MUNDY, O. J. SMITH, W. C. GERMAN, and ROY NEAGLE, COMMISSIONERS, consti- tuting Board of Commissioners of said The City of Las Vegas, Respondents. being Case No. 1969, and Whereas, the said defendants are all officers of said City and the subject matter of said suit arises out of acts alleged to be within the scope of their official duties, and not by reason of any act or omission by them or either of them as individuals or outside the scope of their official duties, and neither of said defendants has employed an attorney in said action and all desire that the City employ an attorney for and on their behalf to defend said action, and Whereas the City Attorney declines to defend said action without additional compensation upon the ground that such defense is out of the scope of his official duties, but is willing to defend said officials in the said District Court for the sum of Five Hundred Dollars payable Three Hundred dollars down as a retainer and the balance at the termination of said action in the said District Court, and Whereas, the Board deems it reasonable and right under the circumstances aforesaid that the cost and expense of said action should not fall upon the individual officers as defendants in said action, and that the proposition of said City Attorney is reasonable and lawful, NOW THEREFORE, Be It Resolved that the said City Attorney, F. A. Stevens be and he is hereby employed to defend said action upon the behalf of each of said officers at the compensation above specified, and that a warrant be drawn by the proper officers of the City in favor of said City Attorney for the sum of Three Hundred Dollars as and for a retainer as above specified, the amount thereof to apply upon the total ultimate fee of Five Hundred Dollars ($500.00) for services to be rendered in said action in said District Court. The vote on said resolution was as follows: Commissioners O. J. Smith, W. B. Mundy and W. C. German voting aye; noes, none. Mayor Hesse did not vote on said resolution.
