SOUTHARD, doing business as SOUTHARD and DOWNEY 3 (a fictitious name), (hereinafter called "Subdivider), as Principal, and 4 UNITED STATES FIDELITY AND GUARANTY COMPANY , a oorporation organized 5 and existing under the laws of the State of and lawfully 6 SI authorized to do and doing business as a surety within the State of Nevada, 7 as Surety, are held and firmly bound unto Las Vegas Land and Water Company, 8 a corporation organized and existing under the laws of the State of Nevada 9 and authorized to do business within the State of Nevada (hereinafter called 10 "Water Company"), in the penal sum of THREE THOUSAND THREE HUNDRED AND FORTY 11 DOLLARS ($3,340.00) lawful money of the'United States of America to be paid 12 to the Water Company, its successors or assigns, for which payment well and 13 truly to be made, we bind ourselves, our heirs, executors, administrators and 14 successors, jointly and severally, firmly by these presents. 15 WHEREAS, the Subdivider is about to enter into a contract in writ- 16 ing dated the V " ^ d a y of 9 V- ,194-7, with the Water Company, covering 17 installation of water mains to serve a portion of Blocks 8 and 10 of Mayfair 01—01 Tract No.2, all in the City of Las Vegas, County of Clark, State of Nevada, 19 which said contract is attached hereto and is hereby made a part hereof as 20 fully as if copied at length herein. 21 NOW, THEREFORE, the conditions of the above obligations are such 22 that if the Subdivider shall well and truly keep all and every of the cove- 23 nants and agreements in said contract on the part of the Subdivider to be 24 kept, perfor ed or complied with and in the manner therein specified, and 25 shall deliver to the Water Company a bill of sale, conveying to the Water 26 Company said pipe line free and clear of all encumbrances, including any and -1 - A -18
