BY SEN. SWANK SECONDED BY SEN. ELLIOTT OBJECTION BY PRESIDENT BUNIN, WHO STATED THAT THERE IS NO LEGAL AUTHORITY OF THE SENATE TO PASS SUCH A REFERENDUM. SECONDED BY SEN. ROSENBERG. PRES. BUNIN STATED THAT THE SENATE HAD NO LEGAL AUTHORITY AS A REFERENDUM IS DESIGNED TO PUT A LAW ON WITH SPECIFIC DATES, AND IS PART OF THE JURISDICTION AND AUTHORITY OF THE JUDICIAL COUNCIL. ALSO, IF THAT REFERENDUM WAS PASSED ALLOWING CANDIDATE X ON THE BALLOT, THAT PERSON WOULD BE ON THE BALLOT EVERY YEAR FROM THE DATE ON. CHIEF JUSTICE DAN WALL STATED THAT NO LEGAL BASIS FALLS UNDER THE SENATE'S JURISDICTION, THEREFORE, AS IT HAS NO BASIS, THE MOTION SHOULD BE RULED OUT OF ORDER. THE OBJECTION FAILED WITH SEN. SWANK REPLIED THAT THIS IS THE ONLY DAY TO DO IT, AS THE ELECTIONS ARE BEFORE THE NEXT SENATE MEETING. PRES. BUNIN STATED THAT THE LEGISLATIVE PROCEDURE CAN CHANGE THE TIME FRAME IF NECESSARY. SEN. GONZALEZ STATED THAT THE ELECTION BOARD IS COMPRISED MOSTLY OF SENATORS, AND IF THE REFERENDUM IS AN OPINION OF THE ELECTION BOARD ACTIONS, THEN IT IS ALSO AN OPINION OF THE SENATORS, AND A SLAP INTO THE FACE OF SENATORS AND NON-SENATORS . SEN. BENNEMAN STATED THAT ALL DISCUSSION IS NEEDLESS AS THE MOTION IS WAY OUT OF ORDER. PRES. BUNIN STATED THAT HE STRONGLY DISAGREED WITH SENATOR GONZALEZ DUE TO THE FACT THAT THE SENATE APPROVED THE PEOPLE WHO MADE THE DECISION, AND THAT NO ONE CAN QUESTION THE INTEGRITY OF SHEILA NELSON, SEN. COLEBROOK, SEN. PRATT, SEN. KERSHAW, AND THE REST. PRES. PRO TEM SMITH STATED THAT IT WAS A MATTER OF INTERPRE-TATION. PRES. BUNIN STATED THAT EVEN CHRIS ROBERTSON AGREED, RENDERING THE POINT MUTE. SEN. BUNIN AGREED WITH SEN. BENNEMAN, THAT THE SENATE HASN'T THE RIGHT TO QUESTION IT. SEN. SWANK STATED THAT HE YIELDS THE FLOOR TO CHRIS ROBERTSON. SEN. TABOLA STATED TAHT THERE WAS NO POINT, AS THERE IS NO QUALIFICATION ON THE VOTING, IT IS A MUTE POINT, THEREFORE THE QUESTION SHOULD BE RECALLED. PRES. PRO TEM SMITH CALLED A RECESS AT 5:37 PM PRES. PRO TEM SMITH CALLED THE MEETING TO ORDER AT 5:44 PM PRES. PRO TEM SMITH RULED THE MOTION OUT OF ORDER AS IT IS NOT IN THE SENATE JURISDICTION. SENATE MEETING 2 0-16 MARCH 29, 1990 -13- IX. OPEN DISCUSSION PRES. PRO TEM SMITH YIELDED THE FLOOR TO CHRIS ROBERTSON. CHRIS ROBERTSON STATED THAT ARTICLE IV OF THE LEGISLATIVE BRANCH SAYS THAT A 2/3 SENATE VOTE IS IMPOWERED TO REFER PROPOSALS TO MEMBERSHIP, ALSO THAT A REFERENDUM, UNDER ARTICLE VII, A SIMPLE MAJORITY VOTE TO PASS. ROBERTSON STATED THAT THERE IS A CONSTITUTIONAL BASIS OF THE SENATE RIGHTS TO MAKE A REFERENDUM, AND THAT HE IS NOT ASKING TO PUT IN A PERMANENT RULE, GIVEN THAT A REFERENDUM EQUALS A PROPOSAL TO THE STUDENTS, THE SENATE HAS NO RIGHT NOT TO PRESENT THIS TO THE STUDENTS. ROBERTSON ALSO STATED THAT HE JUST RECEIVED 7 00 SIGNATURES ON HIS PETITION WITHIN THE LAST FOUR HOURS STATING THAT TO DISQUALIFY HIM IS UNJUST. ROBERTSON ALSO MADE THE POINT THAT THE SENATE VOTED THEM-SELVES OUT OF ONE OF THEIR RIGHTS, AND THAT THAT IS SCARY. SEN. TABOLA ASKED IF MR. ROBERTSON WAS OPEN TO QUESTIONS, AS HE WOULD LIKE SOME CLARIFICATIONS. SEN. TABOLA STATED THAT THE 700 SIGNATURES ARE GOOD, BUT THAT THEY DO NOT REPRESENT A MAJORITY AS IT HAD BEEN TAKEN THROUGH THE GREEK SYSTEM AS A GREEK PROBLEM, AND THAT IT WASN'T TAKEN OUT TO THE UNIVER-SITY SYSTEM AS A WHOLE. SEN. TABOLA ASKED IF MR. ROBERTSON COULD BACK UP HIS STATEMENT THAT THE PETITION IS REPRESEN-TATIVE OF A MAJORITY OF STUDENTS. SEN. TABOLA ALSO STATED THAT THE MAIN ISSUE IS THE ELECTION BOARD POLICY, AND THAT THE REFERENDUM HAD BEEN WORDED BADLY. CHRIS ROBERTSON STATED THAT THE PEOPLE WHO SIGNED THE PETITION HAVE BEEN DIRECTLY AND IMMEDIATELY AFFECTED BY THE SITUATION, AND THAT YES, THE MAJORITY ARE GREEK, BUT THAT MOST OF THE VOTES COME FROM THE GREEKS. HE ALSO MENTIONED THAT TOMORROW MIGHT ADD ANOTHER 1000 SIGNATURES, AS THE PETITION IS SENT FROM ONE AREA TO ANOTHER ON CAMPUS. SEN. SWANK SAID THAT MOST OF THE VOTERS ARE COMPRISED OF GREEKS AS MR. ROBERTSON STATED, AND THAT ALOT OF THE SIGNATURES ON THE PETITION COME FROM PEOPLE LIVING IN THE RESIDENCE HALLS. PRES. PRO TEM SMITH REQUESTED THAT SEN. SWANK SHOULD SAVE THE COMMENTS FOR HIS TURN IN OPEN DISCUSSION. SENATE MEETING 2 0-16 MARCH 29, 1990 -14- IX. OPEN DISCUSSION ( CONT. ) PRES. BUNIN STATED THAT CHRIS ROBERTSON, WHO IS AN EXCELLENT SPEAKER, DOES NOT HAVE A PROPER UNDERSTANDING OF THE SITUATION, AS REFERENDUM REFERS TO PROPOSALS TO PEOPLE ONLY IN LEGAL JURISDICTION, THEREFORE IT IS NOT BINDING. HE SAID THAT THE PROPOSALS DEAL ONLY WITH THE LEGAL FRAMEWORK, WITH A SPECIFIC LEGAL FUNCTION TO MAKE THE LEGISLATURE RUN SMOOTHLY. ALSO, THE PETITION SAYS THAT THE "STUDENTS ARE BEING DENIED A CHOICE." WHICH STINKS, BUT THAT ONE MONTH AGO CHRIS ROBERTSON FILED A COMPLAINT AGAINST HIM WHEN THE YELLING REBEL ARTICLE PUBLISHED AN ARTICLE, CLAIMING THAT THAT WAS CAMPAIGNING, EVEN THOUGH HE AND HIS SUPPORTERS DID NOT VIOLATE RULES, AS FOUND BY THE ELECTIONS BOARD, WHILE CHRIS ROBERTSON WAS FOUND TO HAVE VIOLATED THE RULES. PRES. BUNIN STATED THAT DISQUALIFICATION WAS NOT A PROBLEM UNTIL IT AFFECTED CHRIS ROBERTSON PERSONALLY. WHAT A DOUBLE STANDARD, ESPECIALLY AS THE PEOPLE WHO SIGNED THE PETITION DID NOT HAVE THE FULL STORY, ONLY THE ROBERTSON SIDE. PRES.
