H A R D I N G , S A M U E L K N I G H T . January 15, 1902. Hampton E. George, Esq., Administrator of" the estate of* Aaron Winters, deceased, Los Vegas, Nevada. Dear Sir:- Mr. Benjamin Sanders, an attorney of Pioche, Nevada, informs us that you are the administrator of the estate of Aaron Winters, deceased. We have had consider­able correspondence with Mr.• Sanders regarding the agreement executed by Winters to Mr. Fred Clark for the sale to him of the Green Monster Mine, and for your information we will briefly narrate the facts. On October 12th, 1899, Winters entered into an agreement with Mr. Clark, by the terms of which he agreed to sell to him the Green Monster Mine for the sum of $2,500. He paid $250 to Winters at the time of the execution of the agreement, receipt of which is acknowledged in the instrument. On December 50th, he paid to him the further sum of $100, which payment is evidenced by a draft drawn by Mr. Clark upon P. A. Brown at Manvel, California, payable to the order of Winters and endorsed by the latter. Mr. Clark also, before learning of Winters' death, drew drafts upon Brown at Manvel to meet the payments due February 1st and March 1st, 1900. Stella A. Merritt was appointed administratrix of Winters' estate in \ 2. H. E. G.. California, and learning that "the draffs were in Mr. Brown's hands, she made demand upon him for their delivery to her. He delivered the drafts to the administratrix; they were endorsed By the latter and paid by Mr. Clark in due course. Mr.’ Keely, by whom this letter will be handed to you, has a copy of the agreement with Winters, which he will deliver to you. He also has the original drafts referred to, which, of course, you are at liberty to' examine. You will see therefore that the following payments have been made' upon the contract: October 12, 1899............. $250. December 30, 1899 ............... 100. Paid to Winters' administratrix in California............... 200. T o t a l ............................... $550. L e a v i n g .......................... $1950 of the purcha.se .price unpaid. We have placed all these facts before your attorney, Mr. Sanders, and have suggested to him that inasmuch as it would be a long trip for you to go from Los Vegas to Piobhe, we would make the .payment to you at Los Vegas. Mp. Keely has the money with him and will make the payment, upon your executing a receipt which we have pre­pared for the purpose. In order that you might be assured of the propriety of your receiving the money and executing phe receipt, we requested Mr. Sanders to send us a letter addressed to you advising you what to do in the matter. We enclose the same herewith. Upon reading it you will see that, in"Mr. Sanders' opinion, you should accept the money and H. G. execute a proper receipt. We have not yet determined what course to pursue'in order to-pass the title to the purchaser, but are now giving this subject attention, and will communi­cate with both you and Mr. Sanders when we have reached a satisfactory conclusion. We will say for your information that. Mr. Fred Clark is the business manager of Mrs. Phebe A. Hearst, and he is acting in this matter in her behalf, but as the bond runs to him, it is necessary that the receipt for the money should be made out in the same way.
