On motion of Commissioner German, seconded by Commissioner Mundy the following Preambles and Resolution were duly adopted: WHEREAS, Clark Street Between Sixth and Seventh Streets, in Wardie Addition to the City of Las Vegas, and the alley between Sixth and Seventh Streets from Clark Street to Bonneville Street in said Wardie Addition, have been and are becoming in an impass­ible condition by reason of being flooded with water leaking from the water main supplying water to said section, and WHEREAS the Water main supplying said Wardie Addition to the City of Las Vegas in the alley above mentioned is in such a con­dition that a continuation of the present condition constitutes and is now a nuisance and a menace to the residents of said section of said City of Las Vegas, and WHEREAS, said leaking water main has now caused considerable damage to the said street and alley and if said condition is allowed to continue will cause further damage to said street and alley, and may cause damage to the property bordering oh same, and WHEREAS demands have been made upon the has Vegas Land & Water Company, the South Nevada Land & Development Company, and the Miller-Buzick Corporation, each of which are corporations doing busi­ness in the City of Las Vegas, State of Nevada, to repair the same, and WHEREAS, no consideration has been given by any of the above corporations to the demands made by the City, NOW THEREFORE, BE IT RESOLVED, that the City of Las Vegas, by and through its proper department, repair or cause to be repaired the said pipe line so that said condition will be remedied, and for that purpose the said de­partment is hereby authorized and directed to repair the same; BE IT FURTHER RESOLVED that as soon as said repairs are made, the said department making said repair or repairs render a statement to the Board of Comm­issioners showing the actual necessary cost thereof, and that immediately thereafter the City Attorney bring suit against any and all parties interested or who may be interested in the supplying of said water and the maintenance of said water distributing system, for the amount expended by the City; BE IT FURTHER RESOLVED, that the City Attorney shall also bring such proceedings as he may determine pro­per to compel the parties owning or to own or having charge of the water distributing system for Wardie Addition to the City of Las Vegas, Nevada, to maintain the same in such manner as will adequately serve the people of said Addition with water and not suffer any damage to be done to the streets and alleys of said City. Vote on said Resolution was as follows: Commissioners Mundy, German and His Honor the Mayor voting aye. Noes none.
