PROPOSED ORDINANCE An ordinance entitled: AN ORDINANCE TO AMEND SECTION 2 OF ORDINANCE NO. 688 BY Liquor Ordinance Amendment PROVIDING THE BASIS FOR DETERMINING THE NUMBER OF LIQUOR LICENSES TO BE ISSUED; AMENDING SUBSECTION (16) OF SECTION 3 OF SAID ORDINANCE, AS AMENDED BY ORDINANCE Referred to Committee NO. 714, BY DEFINING SHOPPING CENTERS; REPEALING SUBSECTION (19) OF SECTION 3 OF SAID ORDINANCE; AMENDING SECTION it OF ORDINANCE NO. 714; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING OTHER MATTERS PROPERLY RELATED THERETO; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH, was read by title and referred to Commissioners Sharp and Fountain, committee for recommendation. Commissioner Fountain spoke to the group from the Clark County Licensed Beverage Association stating if they would like to go over this proposed amendment he would be glad to meet with them and Mr. Springston said they would be happy to do this. TAVERN AND PACKAGE Commissioner Sharp moved that no applications for tavern or package liquor licenses LIQUOR APPLICATIONS be accepted until the proposed liquor ordinance amendment had been adopted. Not to be Accepted Motion seconded by Commissioner Fountain and carried by the following vote: Pending Amendment Commissioners Fountain, Sharp, Whipple and His Honor Mayor Gragson voting aye; noes, Adoption none. Absent: Commissioner Elwell. -oOo- At the hour of 8:50 p.m. the meeting was recessed and reconvened at the hour of 9:00, p.m. with all members present as of the opening session. -oOo- LIQUOR APPLICATION Commissioner Whipple moved the application of Philip J. Granger for a restaurant Change of Ownership beverage license at the Red and White Cafe, 801 South 1st, presently owned by Don Red and White Cafe Nagley, be approved and the Supervisor of License and Revenue authorized to issue the license. Police report was favorable on the applicant. Approved Motion seconded by Commissioner Fountain and carried by the following vote: Commissioners Fountain, Sharp, Whipple and His Honor Mayor Gragson voting aye; noes, none. Absent: Commissioner Elwell. CIGARETTE APPLICATIONS Commissioner Sharp moved the following cigarette licenses for additional locations Additional Locations be approved and the Supervisor of License and Revenue authorized to issue the licenses: Approved WEST SIDE MOBIL Owens and "D" Sutton Vending Co. FRANK MILLER GARAGE 1527 South Main Sutton Vending Co. DOG HOUSE 1424. South 3rd Sutton Vending Co. RICHFIELD SERVICE 15th & Fremont Sutton Vending Co. COFFEE BREAK TEA ROOM 210 South b.th Sutton Vending Co. DOUGLAS APARTMENTS 316 Cleveland Sutton Vending Co. Motion seconded by Commissioner Whipple and carried by the following vote: Commissioners Fountain, Sharp, Whipple and His Honor Mayor Gragson voting aye; noes, none. Absent: Commissioner Elwell. CIGARETTE APPLICATION Commissioner Fountain moved the application of Mrs. Emma Alice Cannon for a cigarette New license at Cannon's Snack Bar, 409 Jackson, be approved and the Supervisor of License Cannon's Snack Bar and Revenue authorized to issue the license. Police report was favorable on the applicant. Approved Motion seconded by Commissioner Whipple and carried by the following vote: Commissioners Fountain, Sharp, Whipple and His Honor Mayor Gragson voting aye; noes, none. Absent: Commissioner Elwell. CIGARETTE VENDING Commissioner Sharp moved the application of RaLph T. Warne, President, Raymond R. OPERATORS APPLICATION Finn and Emma E. Sportsman for a cigarette vending operators license at the Nevada Nevada Vending Machine Co. Vending Machine Company, 8 East Charleston, be denied on the basis of the police report. Denied Motion seconded by Commissioner Fountain and carried by the following vote: Commissioners Fountain, Sharp, Whipple and His Honor Mayor Gragson voting aye; noes, none. Absent: Commissioner Elwell. REZONING Z-13-59 The Commission considered the application of Richard Tam for reclassification of Richard Tam property on the north side of San Francisco between Fairfield and Industrial Road from R-4 to C-1. Approved This application was previously approved by the Board of City Commissioners and the rezoning was included in a proposed ordinance which was in Committee and upon request of the Planning Commission it was deleted from this proposed ordinance and returned for further study. Approval was again recommended by the Planning Commission with the stipulation that, in accordance with the provisions of Chapter 24, Section 20, Paragraph E of the Zoning Ordinance, the use of this property be limited to development generally as shown on the plot plan submitted by the applicant dated June 23, 1959, O. J. Scherer, Engineer. There was one protest. Commissioner Fountain moved the application of Richard Tam for reclassification of property on the north side of San Francisco between Fairfield and Industrial Road from R-4 to C-1 be approved as recommended by the Planning Commission with the stipulation that the use of this property be limited to development as shown on the plot plan dated June 23, 1959, and the City Attorney be instructed to prepare the necessary ordinance amendment. Motion seconded by Commissioner Sharp and carried by the following vote: Commissioners Fountain, Sharp, Whipple and His Honor Mayor Gragson voting aye; noes, none. Absent: Commissioner Elwell. 8-5-59
