The la t t e r circu lar is the only one f ile d with the Interstate Commerce Commission and therefore the only circu lar having any force in the eyes of that Commission. trouble are small in amount. However, you w ill observe Circular 10-K issued by Agent oomph, Buie 8, Section D» authorises the observance of actual weight of any carload shipment submitted by the consignor or consignee, either by means of shipper’ s authenticated invoice, by weighing the entire load on platform scales, or by weighing a proper portion not less than 10^ over standard scales. I mention this rule in order to make clear that the question of tolerance allowance is not involved in these claims. that he kindly furnish both you and me a written opinion as to the le g a lit y of our protecting weights supported by a ffid a v it of the shipper or party loading the car as opposed to the weights secured by the railroad company provided we are satisfied that such weights supported by such a ffid a v its are fa ir ly entitled to fu ll consideration and th eir acceptance recommended by the T ra ffic Bept. or the Accounting Dept. w riter’ s personal knowledge shippers’ weights are continually accepted by other carriers providing they are supported in a manner satisfactory to those c arriers. with desire expressed by you in our conference concerning this subject, and with a view to disposing of this question fin a lly and permitting^ the disposition o f a number of small claims which are needlessly taking up the time and attention both of your department and mine; and further­more, causing dissatisfaction among shippers on account of weights not being protected which the shippers are honestly assured are the correct weights.
