Los Angeles, lfay 7, 1951 Mr, Calvin Cary: Is there anything in your eld oerre- spondence file indicating that contract dated March 30, 1929 between LA&SL and LVL&WCo., Audit No. 7322, covering transportation of water through railroad pipeline to distribution system of LVLfcWGo* at Las Vegas was submitted to the Nevada Public Service Commission for approval at the time it was executed under Nevada Compiled Laws 1929 - Section 6147 to 6149? Our files do not indicate that sueh approval was sought. No approval was sought for the new contract dated November 30, 1950, N.P. Audit No, 74531. I do not know whether the City Attorney will make any point of it at the rate increase hearing but failure to seek approval may be justified on the grounds that the contracts do not provide for a sale of water.
