Bennett - Los Angeles: At the present time we have contract with the City of Fillmore which was effective May 16, 1923, for a period of 50 years, terminable upon 6 months notice, a monthly charge of 112.00 being assessed for water furnished for the Railroad Company's use. In view of present conditions at Fillmore, this charge appears to be excessive and, therefore, an investigation was instituted by this office and Trainmaster Baker along with Asst. Division Engineer D. S. Clement contacted the Honorable Mayor H. Johns and found the City of Fillmore charges a minimum of #4.50 for the first 30,000 gallons of water per quarter. It is conservatively estimated that with the Company facilities at Fillmore, we will not exceed 5,000 gallons of water per month, or 15,000 gallons per quarter. I understand that no agreement would be necessary after cancellation of the present agreement. The City of Fillmore would simply install a 2«ineh: water meter at a cost to us of f125. After the installation of the meter water would be supplied to the Union Pacific under standard water users' agreement. Having in mind the legal feature behind such a move as this, would appreciate your views as to the cancellation of the contract, and in the meantime will handle with G-eneral Manager Paulsen with respect to the expense of installing water meter at Fillmore.
