S § Under date of February 12th I received an \ Inquiry from Mr. Ashby as to my recommendation for application of the recently approved increase granted Railroad clerical farces to LVL&W Co. employes at Las Vegas, upon receipt of which in discussing with you I brought to your attention that in accordance with advice from Mr. McNamee these employes were not made subject to the Fair Labor Standards Act, but that in discussing the present situation with Mr. McNamee he advised he rendered the same opinion in connection with the Southern Nevada Power Company, which opinion was later reversed by the Supreme Court and the Power Co. employes placed under the Fair Labor Standards Act. as to the applicability of this Act to clerical and labor forces of the LVL&W Co. at Las Vegas, and I believe you communicated with Mr. Bockes by 'phone with respect thereto. anxious to handle this matter to a conclusion, will appreciate if you will let me have an opinion in the matter.
