Las Vegas, H«t ,| &eptabOP 29, 1952 Mr* Wm. Relataardtt (CC * MT. E. e, Bennett) Attached Is copy of correspondence with Mr. E. W* Cragin concerning charge for water for cooling refrigeration equipment serving the El Portal Theatre, Las Vegas, in amount < $646.00, for the period of January 1st to and including August SI, 1962, together with copy of letter dated September 9, 1952, from Chairman Robert A. Allen of the Nevada Publlo Service Commission, In which he suggests a restudy of the basis of our charge and questions the correctness of the charge during the winter period. As regards the second paragraph of Mr. Allen * s letter to the effeot the rates were based upon ncm-recirculating equipment, a review.of our file discloses that we filed with the Commission an cunendatory and supplemental schedule of rates to be effective October 1, 1984, a copy of which is attached, together with copy of exchange of correspondence between Mr. Bracken and the Public Service Commission. The supplemental schedule and all of the correspondence tends to confirm our position that the rates in effeet were based upon assumption all refrigeration machines would be equipped with recirculating systems as required by City Ordinance. As suggested In Mr. Bennett*s letter of September 15th I have had numerous conversations with and letters from customers, including among others* Mr. E* w. Cragin, Owner of the El Ported. Theatre, Mr. Fred Soly, President of Monte Carlo, Mr. 0. C. King, Asst. Secretary, Golden Nugget California Club, Mr. Hoed Whipple, Asst. Vice President, First National Bank Mr. R. E« Thorn, Manager, Sears, Roebuck and Co„ concerning our refrigeration charge. In each instance, the complainant contends i 1 - The rate is exorbitant for machines equipped with recirculating devices. 2 - As air conditioning equipment is generally used only during period May through September, there is no justification for oharge for remaining months of the year.
