Cory - Las Vegas) - s/ Referring to your A-669 of August 8 and your A-511 of September 4,/file 914, relative to apparent unauthorized use of water from the pipe line serving Arden, Nevada, by Mr. Cy Rouch: SEP 119623 U. v-. v, SEP m$ Herewith, four (k) prints of Division Drawing No. A-1590 showing the alignment of our pipe line and the pipe line engineering station of the unauthorized hose bib connection. Also shown are two parcels of land,apparently the property of Mr. Jose Jauregul, which otar pipe line crosses. At this time we have been unable to determine the relationship as to Mr. Rouch occupying Mr. Jauregul*s property, as neither of the two gentlemen have been available during recent attempts to contact them. If we are legally committed to allow this water con­nection by virtue of the fact that our line does cross the pro­perty Involved, then I concur in your view that the matter be resolved by covering the connection and sale of water by appro­priate agreement. However, it is suggested that in event we are not so legally committed, then we may possibly be setting a precedent that could lead to mi eventual deluge of applications for securing water from this pipe line. Should this be the case, it is recommended that Mr. Rouch be informed that there is no surplus water available from the line at this time and that his further use of an unauthorized connection to the pipe line shall constitute just cause for legal action to enjoin him from so doing.
