To consider the acquisition of a right of way on Clark Avenue in said City, from Main Street in said City to the Westerly limits thereof. 2. Minutes of a Special called meeting of the Board of Commissioners of the City of Las Vegas, held on the 11th day of September, 1933 at the hour of three o'clock P.M. The following answered roll call, Mayor E.W. Cragin Commissioners Arnett, Mundy, German and Down, City Attorney Henderson and City Clerk. At this time the Mayor of the City called the meeting to order stating that the meeting was called for the purpose of considering whether or not it would be advisable for the City to accept the proposition of the Los Angeles and Salt Lake Railroad Company whereby said Railroad Company offers to deed to the City a certain right of way over certain parcels of land situate in the western portion of said City and which right of way embraces a parcel of land on Clark Avenue running from Main Street in said City to the Russell property in said City, and WHEREAS, the Railroad company offers to give and grant unto said City the right of way for the construction of a street along the portion of said City hereinabove referred to, and offers to grant an easement to the said City to cross its railroad tracks on said street, to-wit: Clark Avenue, and WHEREAS, in consideration of the said Railroad Company giving and granting to said City said parcel of land for a right of way, and said easement over its railroad tracks, the Railroad Company desires that the City agree to construct and maintain the said street over and across the easement of said railroad tracks approximately one hundred (100) feet long by eighty (80) feet wide, NOW THEREFORE, in consideration of the said Railroad Company's granting to said City right of way and easement, free to cost to said City, BE IT RESOLVED, that the City of Las Vegas, for and in consideration of said tract of land for said right of way, and in consideration of said easement, does hereby agree to and with said Railroad Company to construct and maintain said street over, across, and on that portion of said street over which the railroad tracks of said Railroad Company now run, to-wit: a portion of said street approximately one hundred (100) feet long by eighty (80) feet wide: Providing however that the City in agreeing to construct and maintain said designated portion of said street, approximately one hundred (100) feet long by eighty (80) feet wide, shall in no manner assume any liability or be liable from any cause whatsoever to the property of said Railroad Company or to its trains operating thereOn
