To pay to the Subdivider at monthly intervals, fifty per 5 cent (50%) of the monthly revenue received by it from customers in said Block 6 1 of said respective Subdivision taking water from the water main so installed 7 hereunder, for a period of ten (10) years from the date of the completion of 8 said installation, or, until the Subdivider has- been repaid the actual cost 9 of the line so advanced by it, (excluding, however, the cost of 8001 of 8" 10 cast iron pipe and the actual cost of 120’ of fire hydrant laterals) plus 1 1 the agreed upon sum of $1760.00 for material delivered by the Subdivider, 12 whichever occurs first. 13 ARTICLE III 14 IT IS MUTUALLY AGREED: 15 1. That the water mains so installed shall be and remain the 16 property of the Company. 17 2. Should the actual cost of the installation of said water 18 mains exceed the sum of' $3970.00 (being the amount advanced by the Subdivider 19 plus the agreed upon sum of $1760.00 for material furnished by the Subdivider), 20 then and in that event the Subdivider will pay the excess to the company, upon 21 demand; and if said actual cost be less than $3970.00 then the Company will 22 pay to the Subdivider the difference between said $3970.00 and the actual cost. 23 By actual cost is meant the cost of all material and supplies 24 furnished by the Company (excluding, however, the cost of 800* of 8" cast iron 25 pipe), plus the agreed upon value of $1760.00 for material delivered by the 26 Subdivider to the Company, plus the cost of all labor employed in connection - 3 - A A - 6 9
