Water Company la the owner of a franchise or permit granted by the Board of Commissioners of the City of Las Vegas, Nevada, for a term of fifty years from February gi, 1930, to install, lay down and maintain water pipe lines, water mains and all necessary and proper appliance® used in connection there­with or appurtenant thereto in, through, under or across, under or along all of the streets, alleys, avenues and highway® ©f the City of Las Vegas, County of Clark, State of Nevada, including Clark*® Las Vegas fownsite, the original townslte of Las Vegas, and all addition®, tracts and subdivisions ©slating a® a part of said City on February 21, 1930, and all additions, tracts and subdivisions which thereafter may have or may be added to said City of Las Vegas or thereafter laid out or subdivided for the purpose of supplying the inhabitants of the City of Las Vegas with water. Said fran­chise or permit provides that the Water Company shall not be enti­tled to assign the permit or any rights thereunder without the con­sent of the Board of Commissioners of the said City of Las Vegas first had and obtained in writing. At any time after the escrow provided in Section 9 stall have been opened Water Company agrees, at the request of the District,to request the consent of the Board of City Commissioners of the said City of las Vegas to assign all rights and privileges under said franchise or permit to the Dis­trict, and when said consent shall have been obtained, to assign by appropriate document and deliver to the District through said escrow such assignment, if required by the District.
