CSUN SENATE MEETING 35-09 MONDAY, FEBRUARY 7, 2005 MSU 201, 6:00PM I. CALL TO ORDER SENATE PRESIDENT AMES QUIT A calls the meeting to order at 6:05pm II. ROLL CALL SENATOR CRAWFORD, SENATOR JIMENEZ, SENATOR ESPINOZA, SENATOR BOWERS, SENATOR MACK, SENATOR DEARMES, SENATOR DONNELLY, SENATOR SORVONGSAVANH, SENATOR COCHRAN, SENATOR GABRIEL, SENATOR GONZALEZ, SENATOR JOHNS, SENATOR MOSES, SENATOR WONG, SENATOR WASHINGTON, SENATOR PIRO, SENATOR HA WORTH were present. ( SENATOR HUERTA, SENATOR TEMPLETON and SENATOR ROTH were excused. SENATE PRESIDENT PRO TEMPORE MULLINAX and SENATOR KONNER were unexcused. SENATOR MARAZITA arrived at 6:13pm; SENATOR FLORES arrived at 6:20pm. III. PLEDGE OF ALLEGIANCE IV. APPROVAL OF MINUTES The following minutes are submitted for approval: 35:08 SENATOR DONNELLY moves to approve SENATOR COCHRAN seconds Motion passes unanimously V. PUBLIC COMMENT MOSHEN AZIZS OLTANI: I'm here to support the new business item D. This ( conference is about student research, but some students are always left behind. UNLV is i only representative from the USA. We had the number one papers and books from the last conference. We are taking 3 students to Madrid this year. They have been working on their papers since last semester. In order to take these students we need more funding. With the extra money this meeting could approve, we could be on our way to getting there. We appreciate your help. VI. REPORTS A. Senate Committee Reports SENATE PRESIDENT AMES QUIT A: Rules and ethics did meet, SENATOR TEMPLETON is excused because his cousin got hit by a car. The rules and ethics should be in your boxes. B. Liaisi.o nS Rtuedpeonrtt sI nvolvement Activities TOM STUDDERD: We don't have anything to report but we are still recruiting for the committees that I told you about last week. ii. Residence Hall Association SENATE PRESIDENT AMESQUITA: Rebel romance at UNLV, the RHA is putting it on, you can buy a date or be bought. iii. Student Athletics iv. Student Health Advisory Committee LATOYA: Sunday there is free HIV testing. For anyone that needs a work study, the health center is looking for 2 people. SENATE PRESIDENT AMESQUITA: How much does that pay? LATOYA: 8 dollars and you receive raises the longer your work there. v. ROTC ABBITE: Wednesday we have physical training event. We are working on more battle tactics, Friday we have a 6 mile march in Red Rock. SENATOR JIMENEZ: What do you do to join ROTC? 2 ( ABBITE: You have to sign up with the class online. SENATOR JIMENEZ: Do you have to be physically fit right? ABBITE: Yes. SENATOR JIMENEZ: How many members do you have? ABBITE: 60. SENATOR JIMENEZ: Is that average for a university? ABBITE: Yes. SENATOR JIMENEZ: Do you get the kids from high schools? ABBITE: Yes, but we do a lot different training then they do, ours is more officer training, they just learn to march. vi. Leadership Advisory Board No Report E. Rebel Yell Report SENATOR JOHNS: Vice chair resigned because she is going to go out of town and they are looking for a new person. SENATOR MACK: The RJ was representing the students at UFC. They are doing a lot of recognition for station casinos. VII. Information Item: Presentation by Head Cheerleader Coach Nakia Jackson. She was not Present VIII. EXECUTIVE BOARD ANNOUNCEMENTS VICE PRESIDENT GOATZ: I'll save for the end. SENATE PRESIDENT AMESQUITA: Akiona did resign. Do we appoint on 14th or wait till the 28th? I VICE PRESIDENT GOATZ: We doing it on the 28th. 3 ( SENATE PRESIDENT AMESQUITA: Be on time, no more being late. When we get done with consent agenda, Tunnel of Oppression should be first today then we need to move back the order of the day. PRESIDENT SCHUCK: Board of Reagents was past this week. They approved all the fees without opening up discussion. I was chairing a different board so I wasn't there. Summer school fees went up, music fee went up for the Fine Arts College. Lessons went up to $400. Peter stepped in and helped so it wasn't $500. Spurlock is in 2 weeks. We spent a lot of money for him and everyone needs to tell people from your classes. The date on the flyers is wrong, it's a Wednesday lecture. Email went out to all faculty, and 300 students as well. The shuttles are in and waiting for drivers and they built a storage area for them, I'm happy to answer anyone's' questions. SENATOR BOWERS: Where is the podium? PRESIDENT SCHUCK: Its downstairs. SENATOR JOHNS: PRESIDENT SCHUCK got the right cameras so good for him. PRESIDENT SCHUCK: They will do exactly what we want them to do. I really think it is stupid that we don't hear the reports from directors anymore. I don't understand why, you're the oversight and you need to hear what they have to say. SENATE PRESIDENT AMESQUITA: New York Times was out today, the rack in the MSU seems to have been hit the most. So I had to redistribute them myself. They are going to be watching how they get hit and figure out where they really need papers. Everything went really well. SENATOR CRAWFORD: Where are they? SENATE PRESIDENT AMESQUITA: BHS, fine arts, Lied Library, CBC, Dinning Commons, etc SENATOR BOWERS: Are directors considered stipend positions? SENATE PRESIDENT AMESQUITA: I guess they are. SENATOR BOWERS: Bylaws say that they have to be here. SENATOR CRAWFORD: Is there a plan to secure the racks for the New York Times? SENATE PRESIDENT AMESQUITA: They are going to get chains and some of them are inside. 4 SENATOR JOHNS: Someone broke into a bunch of vending machines over the weekend, so they need to be secured. IX. CONSENT AGENDA-APRROVED A. Action Item: Approval of Adrian Viesca to serve as the Office of Student Information Assistant Director for a term ending April 30, 2005. As submitted by the Executive Board. APPROVED B. Action Item: Approval of a 6 credit fee waiver to be paid to the Assistant Director of the Nevada Student Affairs for the Spring 2005 semester. Costs to be encumbered from the CSUN 2702 FY 05 Nevada Student Affairs (Discretionary) account. As submitted by Senator Espinoza on behalf of Director Blood. SENATOR PIRO requests to have item approved seperately SENATOR COCHRAN moves to approve SENATOR DEARMES seconds SENATOR PERO: Why are we giving a 6 credit waiver to assistant? VICE PRESIDENT GOATZ: She has been helping her out with this before, ASISTANT DIRECTOR HOLMQUIST gets 12 credits for example. Item passes 18-0-1 SENATOR CRAWFORD abstains C. Action Item: Approval of committing Senate Bylaw 68 to the Bylaws Committee for review. As submitted by Senator Moses, Senator Jimenez. APPROVED D. Action Item: Discussion/Approval of committing Article 4 section 4 of the UNLVCSUN Constitution to the Constitutional Revisions committee for revisions to include a GPA of 3.0 and at least 9 credits per semester for Executive Officers and increasing the number of credits required for the Legislative Branch to 9 credits and an increase of the GPA to 2.5. Action Item: Approval of the CSUN Senate Rules for the 35th Session as proposed by Senator Templeton of the Rules and Ethics Committee. SENATOR JIMENEZ moves to approve SENATOR FLORES seconds 19-0-0 Motion Passes C. Action Item: Nomination/Selection of one (1) Senator to serve as Chairman of the Ways and Means Committee for the remainder of the 35th Session. As submitted by Student Senate President Amesquita. SENATE PRESIDENT AMESQUITA: For your information, you can postpone this because he has been missing. SENATOR FLORES move to open nominations SENATOR PIRO seconds SENATOR DEARMES opposes 6 18-1-0 nominations are opened SENATOR WASHINGTON moves to nominate SENATOR JIMENEZ SENATOR PIRO seconds SENATOR WASHINGTON: It was based on resignation. SENATOR PIRO: Do we really want to wait for this guys resignation. Lets appoint someone right now SENATOR WASHINGTON: Which one out weighs the other, resignation or him not fulfilling the bylaw? SENATE PRESIDENT AMESQUITA: If he doesn't meet the requirements, then it goes to rules and ethics. It might be easier to wait till the next meeting. We need to make it so the senate president can take him off. SENATOR CRAWFORD motions to postpone till next week 35-11. SENATOR COCHRAN seconds SENATOR CRAWFORD: According to bylaw 49 we could have removed him last semester but now he is taking at least 6 credits, so now we have to wait till he misses three senate meetings. SENATOR FLORES: How much longer are we going to wait for this? SENATOR MACK: I agree due to the fact that there has been a lot of tampering with the budget. I would like to vote for him right now. SENATOR BOWERS: Is the budget already set? He doesn't go back and reallocate. SENATE PRESIDENT AMESQUITA: Anyone can get a current budget whenever from BUSINESS MANAGER DAVE HILL, but no one does. They used to do it with Powell. He would stand up every week and say exactly what is going on. SENATOR WASHINGTON: If we could find the correct process, I think that would be a plus. So don't keep making mistakes like we have. If someone has the expertise to do this they should. SENATE PRESIDENT AMESQUITA: five minute recess 7:35pm Called back to order at 7:45pm 7 SENATE PRESIDENT AMES QUIT A: There is no executive power to remove him. We have no way to remove him other then wait till next week. 17-0-0 motion passes XI. NEW BUSINESS A. Action Item : Approval of an amount not to exceed $1950 to be paid to the College of Sciences for the registration of thirty (30) Caucasian students with the National Marrow Donor Program (NMDP). Cost to be encumbered from the CSUN 2702 FY05 Textbook Assistance Budget. As submitted by Senator Crawford. SENATOR DONNELLY motions to move out of the order of the day to action item B SENATOR FLORES seconds Motion passes 19-0-0 SENATOR CRAWFORD moves to approve action item A SENATOR WASHINGTON seconds SENATOR CRAWFORD move to amend striking "textbook assistance budget" to "senate discretionary budget" SENATOR DONNELLY seconds SENATOR MACK: I'm curious about the textbook assistance budget. SENATE PRESIDENT AMESQUITA: PRESIDENT SCHUCK can move it and I get a letter VICE PRESIDENT GOATZ: So it should have $25,000 left give or take. 19-0-0 motion passes Item is amended SENATOR ESPINOZA: It's a great cause but I don't think we should be using student money for this when we could be doing something for our students. SENATOR WASHINGTON: The registration is for 30 Caucasian students? 8 SENATOR CRAWFORD: Minorities are paid for, so the Caucasians have to pay for there registration. We may not get to 30. We are doing this for a group of students who did not get the grants. It is a $65 registration fee. SENATOR MARAZITA: I don't think this is a good idea. SENATOR PIRO: This is a great idea. It serves everyone. As long as we approve it out of discretionary. SENATOR WASHINGTON: I have a question about the naming of where we take money from. Do we have to go back and say where the money comes form if its name changes? SENATE PRESIDENT AMESQUITA: There is no more text book account. VICE PRESIDENT GOATZ: We are acting as a business, so if you release money from it right now then it comes from it. SENATOR MARAZITA: I want to remind that we are senators of our colleges. SENATOR DEARMES: yield the floor to DIRECTOR ARNESON. DIRECTOR ARNESON: I was wondering what the program is? And is our name out that we are sponsoring it? SENATOR CRAWFORD: When I make up fliers, CSUN name will be on the fliers. DIRECTOR ARNESON: I think its great to help the community. Is there any way CSUN will get positive recognition for this SENATOR CRAWFORD: Yes, we have space rented out downstairs and have the source room. Item passes as amended 1 8 - 1 - 0 SENATOR MARAZITA opposes B. Action Item: Approval of an amount not to exceed $2000.00 to be paid to Ricardo Laguna for damages to professional equipment at last year's Rebelpalooza. Costs to be encumbered from the CSUN 2702 FY 04 Reserves Account. As submitted by Senator Piro. SENATOR COCHRAN moves to approve 9 ( SENATOR DEARMES seconds SENATOR ESPINOZA: I have seen this a few times. What is going on? DIRECTOR ARNESON: We hired him last year with the rest of the people in his bmx crew. A skateboard broke the camera. We will still pay $1,500 if they make a claim to the insurance company against us and we will also have raised rates. They thought that in our best interest we should just pay for it. SENATOR ESPINOZA: We are held responsible because, for this, we held the event. SENATOR JOHNS: I know some people who also do bmx, and they say that the camera isn't even really broken. The guy was dropped by one of his sponsors before this. SENATOR BOWERS: When was this event? DIRECTOR ARNESON: April 24th. this has nothing to do with me at all. SENATOR FLORES: Are rates would go up with our insurance? DIRECTOR ARNESON: Yes. SENATOR FLORES: Can we use another company? DIRECTOR ARNESON: We often go out to different companies. This is only company that would cover this type of event. SENATOR FLORES: Will the insurance take this claim? DIRECTOR ARNESON: They might not but I don't know, so I can't comment. SENATOR CRAWFORD: In the contracts, is there anything that says we aren't liable to damages to there equipment, is that something? BUSINESS MANAGER DAVE HILL: No. DIRECTOR ARNESON: They need to provide insurance for there own bodies. SENATOR MOSES: Does this mean we are legally obligated to pay this guy? BUSINESS MANAGER DAVE HILL: No. SENATOR MOSES: What was he taping for? DIRECTOR ARNESON: His own personal use. 10 SENATE PRESIDENT AMESQUITA: Can we pay the guy if they accept the claim? DIRECTOR ARNESON: No. SENATOR MOSES: So is it a long process? SENATE PRESIDENT AMESQUITA: Is there a grand father clause? BUSINESS MANAGER DAVE HILL: I don't know. SENATOR MOSES: How long has he been calling you? DIRECTOR ARNESON: A year. SENATOR MACK: What would you advise? DIRECTOR ARNESON: I think that we should just pay the guy, and it will go away. SENATOR JIMENEZ: The cameras we bought are supposed to be the best and they aren't $2,000. I'm thinking that we need to see the camera. I think that the insurance will say "why do you have a camera there in the first place?" SENATOR MARAZITA: Point of information, the cameras were $3,300 SENATOR WASHINGTON: If we were to pay him, is it possible for him to still file a claim? SENATE PRESIDENT AMESQUITA: Unless he has a notary public take all our obligation away. SENATOR WASHINGTON: We have to cover our butts from bad people. DIRECTOR ARNESON: The proper papers will be done. SENATOR WASHINGTON: So you know what camera it is? DIRECTOR ARNESON: Yes. SENATOR WASHINGTON: Did he say what was wrong? DIRECTOR ARNESON: He said he couldn't use the camera. SENATOR WASHINGTON: Can it be repaired? 11 DIRECTOR ARNESON: He wasn't injured when the skateboard hit the camera and he says it can't be repaired. SENATOR BOWERS: How much do we pay for insurance? DIRECTOR ARNESON: We buy a policy for the day, the ruckus was $4,500. SENATOR BOWERS motions to postpone until 35-11 SENATOR ESPINOZA seconds SENATOR FLORES: We didn't ask for that service. Action Item: Approval of an amount of $4,500 to be taken out of the CSUN 2702 FY05 Senate Discretionary budget for the UNLV Hotel Research conference in Madrid Spain. Submitted by Senator Mack. SENATOR MACK moves to approve SENATOR BOWERS seconds SENATOR MACK: I want to answer some questions first. We are the only representatives for U.S. we compete against schools all over, and we hoping to be host next year. We set a both at the conference for four days and we promote for all we are about. We have an awesome representation, but we have to do a lot more travel then other countries, we are one of best business colleges. SENATOR FLORES: How many students going? SENATOR MACK: 4. 12 SENATOR FLORES: What does it cover? SENATOR MACK: I have a budget going around. SENATOR JOHNS: Are you going Mack? SENATOR MACK: Yes. SENATE PRESIDENT AMESQUITA: Have students gone previously? SENATOR MACK: Yes. SENATE PRESIDENT AMESQUITA: Who paid for it? SENATOR MACK: Bunch of different people. We did get help from CSUN last year. SENATOR FLORES: Are you going to use your CSUN funds for this? SENATOR MACK: Yes. SENATE PRESIDENT AMESQUITA: Toledo? SENATOR MACK: It's planned by the conference. SENATOR FLORES: Are students paying at all? SENATOR MACK: No, they have worked for this. SENATOR GABRIEL: How many applicants were there? SENATOR MACK: 17. SENATOR ESPINOZA: We are representing more then your school. We are the only school from the U.S. SENATE PRESIDENT AMESQUITA: Each person should have $1,250 to work with. SENATE PRESIDENT AMESQUITA: Post conference trip? SENATOR MACK: We tour different types of different hospitality industry places. SENATOR FLORES: So what do you have here for student contributions? Are they paying for there passports? SENATOR MACK: Yes. They get those but we pay for some of there food. 13 SENATOR JOHNS: When do you leave? SENATOR MACK: April 24th. BUSINESS MANAGER DAVE HILL: If it does go through should I just send it to your college? SENATOR MACK: Yes. SENATE PRESIDENT AMESQUITA: If it does go through, the people who don't want to put money to it don't have to. SENATOR JOHNS: I think all this money is ours and we can spend it on whatever we want. SENATOR BOWERS: The way that we set it up, as long as it is under $500, it doesn't have to be discussed. If we want to take this out of a discretionary it can be and that's the way it is written. SENATE PRESIDENT AMESQUITA: Discretionary is all the $1,250 you have. SENATOR BOWERS: I think you are wrong. SENATE PRESIDENT AMESQUITA: Dave, is the discretionary the total for all the senators BUSINESS MANAGER DAVE HILL: Yes. SENATOR FLORES: Okay. I came up with this, $1,950 if every senator gives $50. SENATOR MARAZITA: How much is in the reserves? SENATE PRESIDENT AMESQUITA: I don't know BUSINESS MANAGER DAVE HILL: $49,000 SENATOR MARAZITA: Can we use it from reserves? SENATE PRESIDENT AMESQUITA: We have been using our money from there too much. SENATOR PIRO: No one knows what the text book assistance fund, so we should take it from there and then crush his veto. BUSINESS MANAGER DAVE HILL: There is no longer a text book assistance fund. 14 SENATOR WASHINGTON: The Times is coming from where now? SENATE PRESIDENT AMESQUITA: There is a New York Times budget now. BUSINESS MANAGER DAVE HILL: I advise to take it out of the discretionary. SENATOR ESPINOZA: I seriously doubt that Schuck will veto or not work with us. Henry is a hotel college student and should be working with us. I don't see how Schuck would say this is not something that we should do. SENATOR CRAWFORD: SENATOR MACK, how prestigious is this conference? SENATOR MACK: There should be a good understanding about this, there are many colleges that know about this and we are fortunate to have been invited to this. Mohsen Azizsoltani: This conference is one of the most prestigious conferences in Europe. They didn't want to take anyone from US. It took a lot of work on our part to get invited. It is on of the only conferences that is all about the students and not the teachers. We have to be good to get to this conference and we think we will do as well as we did last year. Last year we got some financial help from you. We are the smallest one there compared to the other countries. SENATE PRESIDENT AMESQUITA: Is there a way to get a grant for this? Is there any strives to not have cash cow relations with CSUN. Mohsen Azizsoltani: I'm trying to bring this conference to Vegas next year and we can have the hotels to fund this. SENATOR JIMENEZ: When we are voting, we should vote as a discretionary fund as a whole. We should do it as a whole and we don't know too much about this $1,250 SENATOR MOSES: Did we say that this was a done deal last meeting? SENATOR FLORES: How much money do we have in discretionary? BUSINESS MANAGER DAVE HILL: $31,000 SENATOR MARAZITA: Why can't we use reserves? SENATE PRESIDENT AMESQUITA: It's like a savings account and we don't want to use until we have to. SENATOR PIRO: I support taking this out of the discretionary account, but I don't think that taking it out of the $ 1,200 for each senator. SENATOR CRAWFORD seconds SENATOR BOWERS: Can you amend the item to send it committee? SENATOR MARAZITA: Didn't we pass these? Why didn't we change these when we passed them? We need to put things on contract that covers our butts, as far as hotel thing I have a big concern about becoming a cash cow. To the hotel college, I hope that you represent when you go to your conference. SENATOR PIRO: I'm putting my $1,250 to the Boys and Girls Club and that combined with my fraternity will get around $5,000 for the club. I think we are working more together as a senate then we have been in the past, take the camera to the insurance. SENATOR MARAZITA: I do not think that CSUN is a community outreach. Why pay money to people who don't pay student fees. Our first priority should be to our students. The reason I voted against the gender thing because we should have discussed it the first time. I think that the directors should be here, I don't think that PRESIDENT SCHUCK should have to be here because he does his job He does more then anyone here.
