Cory: Please see your letter of February 3rd# in response to mine of January 14th, relative to Section 12 of the contract between the Water Company and the Las Vegas Valley Water District. In this letter you recommend that the Water Company should submit an application to the Public Service Commission of Nevada for permission to discontinue service in the City of Los Angeles contingent upon and effective as of the date of the assumption of service by the Las Vegas Valley Water District. You received copy of Mr. McNamee's letter of February 8th concurring in your views) and for your information Mr. Franklin T. Hamilton, under date of February 11th, advised me - "We concur in the view expressed by Mr. Cory and Mr. McNamee. So far as we have been able to ascertain, the only applicable statute is Section 6137# Nevada Compiled Laws, as referred to in Mr. Cory's letter." Under the circumstances, I would appreciate if you would prepare a draft of the proposed petition and send it to me, sending a copy to Mr. McNamee and Mr. Franklin T. Hamilton, 433 South Spring Street, Los Angeles, California, keeping in mind the thought that the effective date of this order permitting the discontinuance of service should be as of the date of the taking over of the service by the Water District.
