Lots Four (4) Five (5), Six (6), Seven (7) and Sight (8) in Block Two (2) and Lots Three (3), Four (4), Five (5), Six (6), Seven (7) and Eight (8) in Block Thirty-three (33) of Original Plat of Las Vegas Townsite, as shown by map thereof on file in the office of the County Recorder of Clark County, Nevada, in Book 1 of Plats, Page 17, and WHEREAS, it appears that the clear title cannot be had at this time to Lots 4 and 5 of Block 2 of Original Plat of Las Vegas Townsite, as shown by map thereof on file in the office of the County Recorded of Clark County, Nevada, in Book 1 of Plats, Page 17, and it appearing to be for the best interests of the city that a different arrangement be made for the purchase of the said property, and WHEREAS, it appears to the Board that it is necessary to rescind that said Resolution and order made on the 15th day of June, 1936, with respect to the purchase of said property, therefore, be it RESOLVED: That that said resolution made and entered by the Board on the 15th day of June, 1936, with respect to the purchase of the said above described property be and the same is hereby rescinded, and be it further RESOLVED; That the purchase of said Lots 6,7, and 8 in Block 2 and Lots 3,4,5,6,7, and 8 in Block 33 of Original Plat, Las Vegas Townsite, as shown by map thereof in the office of the County Recorder of Clark County, Nevada, in Book 1 of Plats, Page 17, be made immediately for Two Thousand Five Hundred ($2,500.00) Dollars cash and that the remainder and residue of the said property, to-wit: Lots 4 and 5 Block 2 be purchased if and when the Golden West Oil and Refining Company can furnish a good and clear title and title insurance to the said property and be it further Resolved: that the Mayor and City Clerk be, and they hereby are, directed to execute and deliver to the Pioneer Title Insurance and Trust Company the following letter of instruction. Pioneer Title Insurance and Trust Company, Las Vegas, Nevada. Gentlemen; With regard to the instructions contained in our letter to you of June 15th, regarding the purchase of certain property owned by the Golden West Oil and Refining Company, a corporation, you are hereby directed to disregard the instructions contained in that letter and in lieu of those instructions you will be guilded by the following. When you issue the City of Las Vegas title insurance in the sum of Two Thousand Five Hundred ($2,500.00) Dollars, showing a good and clear title to the City of Las Vegas, free and clear of all encumbrances, save and except patent reservations, in and to Lots, 6,7,8 in Block 2, and Lots 3.4.5.6.7. and 8 in Block 33 of Original Plat, Las Vegas Townsite, a shown by may thereof in the office of the County Recorder of Clark County, Nevada, in Book 1, of Plats page 17, you will then deliver to Golden West Oil and Refining Company of the money you now hold for the City the cum of Two Thousand Five Hundred ($2,500.00) Dollars, which is payment in full for the said lots. The remaining Five Hundred ($500.00) Dollars you will pay to the said Golden West Oil and Refining Company if and when you can execute to the city title insurance in the sum of Five Hundred ($500.00) Dollars, showing title in the city free and clear of all encumbrances, save and except patent reservations, in and to Lots 4 and 5, Block 8 of the Original Plat of Las Vegas Townsite, as shown by map thereof in the office of the County Recorder of Clark County, Nevada, in Book 1 of Plats, Page 17. The golden West Oil and Refining Company, a corporation, agrees that it will immediately take all steps necessary to furnish the city with a clear title and title insurance to Lots 4 and 5, Block 2, of the Original Plat of Las Vegas Townsite, as shown by may thereof in the office of the County Recorder of Clark County, Nevada, in Book 1, Plats, page 17. And it further agrees that the said title will be furnished the city within a reasonable time, and that the expenses of the said title and escrow will be borne by the Golden West Oil and Refining Company. Provided, however, should you be unable within the months from the date hereof to furnish us title insurance to Lots Four (4) and Five (5) in Block Two (2) aforesaid, as herein provided, then and in such event, on demand of the City, you will return the said Five Hundred Dollars ($500.00), so being held by you, to the City of Las Vegas. It is understood and agreed that time is of the essence of this agreement. Dated this 30th day of June, 1936. BY AUTHORITY OF THE BOARD OF CITY COMMISSIONERS Mayor.
