The Opinion and Order upon which the Company desires reconsideration, or if this is not possible, then rehearing, was made and entered on August 2k , 1951 with the effective date of the new rate schedule as attached to be September 1, 1951. The allegation is made by petitioner that the Opinion and Order deny the Company a hearing and decision in accordance with due, process of law because said Opinion and Order are based in material respects on information and evidence considered by this Commission which are not a part of the record in this case, and which the petitioner had no opportunity to explain or refute. The Commission refers the petitioner to Section 8 of the Nevada Public Service Commission Law, "The Commission may in its descretion investigate and ascertain the value of all property of every public utility as defined in this act, actually used and useful for the convenience of the public.
