    ORDINANCE NO. 234 AN ORDINANCE PROVIDING FOR THE CLEANING OF LOTS WITHIN THE LIMITS OF THE CITY OF LAS VEGAS, AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH, AND PARTICULARLY REPEALING ORDINANCE NO. 91 of the CITY OF LAS VEGAS, APPROVED, MARCH 15, 1922. The Board of Commissioners of the City of Las Vegas, do ordains as follows: Section 1. Every person or person owning a lot or lots the limits of the City of Las Vegas, Clark County, State of Nevada, are hereby required to clean the debris, rubbish garbage, weeks over four inches in height, and brush from the same on or before the 30th day of April of each year, commencing with the year 1938; and thereafter also to clean lot or lots of debris, rubbish, garbage, weeks over four inchces in height, and brush, within ten days after notice, either verbal or in writing, given to such person or persons by the Commissioners of Streets and Public Property in the City of Las Vegas. Failure to comply with any of the provisions of this section or with the requirements of such notice shall be a misdemeanor and every person found guilty of violating any of the provisions of this Section or any requirement of any such notice sall, upon conviction thereof, be fined not less than Five Dollars ($5.00) nor more than Three Hundred Dollars ($300) or imprisonment in the City Jail until such fine is paid at the rate of not exceeding one day for each Two Dollars of such fine in case such fine is not paid, or by imprisonment in the City Jail not to exceed three months or by both such fine and imprisonment. PROVIDED, that when there shall exist debris, rubbish garbage, weeks over four inches in height, or bursh upon a lot or lots owned by a non-resident of the City of Las Vegas contrary to the provisions of this ordinance, a written notice shall be posted by or at the instance of such Commissioner of Streets and Public Property in a conspicuous place on each lot in view of the public, notifying the owner or owners of said lot or lots to clean the same within ten days form the date of posting of such notice; and in the event of the failure of such owner or owners to clean such lot or lots within ten days after the date of posting such notice as aforesaid, the cleaning of said lot or lots shall be done on behalf of said City of Las Vegas by the Commissioner of Streets and Public Property thereof and the cost thereof shall become a debt in favor of said City of Las Vegas against the owner or owners of such lots or lot so cleaned, and the amount thereof may be recovered from the owner or owners of such lot or lots in a civil action to be brought and prosecuted in any court of competent jurisdiction. SECTION 2. Ordinance Number 91 of the City of Las Vegas entitled "AN ORDINANCE PROVIDING FOR THE CLEANING OF LOTS WITHIN THE LIMITS OF CLARK'S LAS VEGAS TOWNSITE IN THE CITY OF LAS VEGAS AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH," Approved arch 15, 1922 is hereby expressly repealed and all other ordinances or parts of ordinances in conflict with the Ordinances are here­by repealed. SECTION 3. The City Clerk is hereby authorized to have this Ordinance published in the Las Vegas Review-Journal, a newspaper printed and published in the City of Las Vegas, Clark County, Nevada, for a period of two weeks, that is to say, once each week for a period of two weeks. AFFIDAVIT OF PUBLICATION STATE OF NEVADA )ss County of Clark ) Dick Lochrie, being first duly deposes and says; That he is foreman of the Las Vegas Evening Review-Journal, a daily newspaper, of general circulation printed and published at Las Vegas, in the County of Clark, State of Nevada, and that the attached was continuously published in said newspaper for a period of Two weeks from April 19th 1938 to April 26th 1938 inclusive, being the issues of said newspaper for the following dates, to-wit: April 19th and 26th That the said newspaper was regularly issued and circulated on each of the dates above named. (Notarial seal) This Ordinance was read aloud to the Board for a first time at a recessed regular meeting of the Board held on the 15th ay of April, 1938, at which time it was proposed, considered and voted upon and unanimously adopted and thereafter published in the Las Vegas Evening Review-Journal, a daily newspaper published in the City of Las Vegas for a period of once a week for two consecutive weeks immediately following its first reading, and it was there­after passed at a recessed regular meeting of the Board held on the 10th day of May, 1938 Voting aye.
