V 1 1 Dear Sir: Your favof of the 21st inst . a&dre to Mr. W.R.Kelly, submitting file in the matter of means suggested to jn’otect our water rights in Nevada, has been referred to me for reply. I have read the letter of Mr. McNamee, and in a general way approve of the suggestions made by him. I am in some doubt as to the plan suggested for the protection of our rights as to the surplus water in Big Springs. On page 3 he suggests: if some tract of land situate below the stream, susceptible to Irrigation, is available, that we take some steps to clear the same and appropriate an amount of water sufficient for our use for all time to the irrigation of the same." If by this Mr. McNamee means that we shall have an entry made by some person upon the land in question, and a filing made upon the water, it is a matter that should be handled very carefully else we might not only let the ri lits slip away from us, but might be accused of adopting a subterfuge in order to acquire these water rights. M.In this connection I would advise most strongly that I would suggest that you ascertain from him more in detail the process which he advocates in this regard. I return herewith file.
