However, there was testimony that there was danger o f a se rio u s water shortage and pending the determ ination o f other p o in ts in v o lv e d , the Commission issu e d i t s order above quoted. Here a ga in , no re fe re n c e i s made to Chapter 23 nor was there any p a r t ic u la r r e f ­erence in the Commission's somewhat lengthy Findings and Opinion that the Commission was r e ly in g on any s p e c ific se c tio n o f the P u b lic U t i l i t i e s A c t. The la t e s t case o f the C a lifo r n ia Commission i s "In the M atter o f the A p p lic a tio n o f C a lifo r n ia Water & Telephone Company, f o r emergency r e l i e f by amending C ertain o f i t s Sweetwater D is t r ic t Rules and R egulations A p p lic a tio n Ho. S2305, D ecision No. 45831, the d ec isio n bein g d ated June 12, 1951. In that case, the C a lifo r n ia Water & Telephone Company f i l e d an a p p lic a t io n with the C a lifo r n ia Com­m ission re q u e stin g an amendment to an e x is t in g r u le (Rule No. 2 ), the amendment to read, a s fo llo w s : "No a p p lic a tio n f o r the extension o f se rv ic e w i l l be granted, nor se rv ic e rendered to , any su b d iv isio n not re c e iv in g service on A p r il 10, 1951, u n less i t i s a su b d iv isio n o f lan d which re ce iv e d ir r i g a t i o n service fo r 12 consecutive months, o r f o r a normal annual i r r i g a t i o n season f o r the crop ir r ig a t e d , durin g the 24 months p recedin g the date o f the a p p lic a tio n , in an amount a t le a s t s u b s ta n tia lly equal to th at which w i l l be re q u ire d in the aggregate by sa id su b d iv isio n , an n u ally, upon the completion o f i t s development, Nothing contained in t h is paragraph s h a ll be deemed to prevent the company from complying with any extension o r su b d iv isio n agreement entered into by the Company p r io r to A p r il 10, 1951. ®No a p p lic a tio n fo r se rv ic e w i l l be accepted o r granted nor se rv ic e rendered to i r r i g a t e lan d f o r commercial a g r ic u lt u r a l pur­poses u n le ss such land re c e iv e d i r r ig a t io n ser­v ic e f o r 12 consecutive months, o r f o r a normal annual i r r ig a t io n season fo r the crop I r r ig a t e d , durin g the 24 months pre ceding the date o f the a p p lic a t io n .*
