Gentlemen: The purpose of th is le tte r is to c a ll to your attention the provisions of the deed to your company executed o rig in a lly in 1902, whereby four miners inches of water (C a lifo rn ia measurement) are to be made a v a il­able at a l l times fo r irrig a tio n of the Stewart Burial Plot, being four acres in the NE-f- SE-J See. 27, T. 20 S. R. 61 E. , M.D.M. The reservation further provides "the waters from Vegas Creek sh all at no time be diverted in such manner as to in terfere with the rights herein reserved, unless provision sh all otherwise be m ade....to convey to the tract of land so reserved the water aforesaid, fo r use as a fo resaid ." I wish to advise you that no water has been available for this land for the past three weeks, and that unless immediate action is taken by you to comply with the provisions above set forth, that I w ill be forced to take le g a l action in the matter.
