B. & M. , with his water rig h t, which would assure us at least 25 inches of water, which could he diverted at any other point in the stream and for any other purpose desired. In th is case the water would have to he sp e c ific a lly mentioned in the conveyance, as a water right is not appurtenant to land (Smith vs. Logan 18 Rev.149). We would not suffer a loss on th is purchase because the water could he used on the land hy lease and taken o ff or sold la te r, as we saw f i t . Without question th is is a good rig h t. 4th: Accept proposition of Cohh Bros., viz: They to give 10 shares in the Muddy Valley Irrig a tio n Co., representing 10 acre-feet of water, providing we deliver to them an additional 10 acre-feet of th eir own water. I would recommend that we continue to use the water in the riv er and in itia te our own righ t, and sink a w ell at once for the purpose of ascertaining how much it w i ll supply. Of the Cohh and Pickett righ ts, the lower and upper: The lower valley people claim that th e ir rights are prior to those In the upper v alle y , as that part was f ir s t settled, and the upper valley people claim that the lower rights have not been perpetuated legitim ately.
