Cory) I have your letter of June 17# 1953# submitting for my approval a typical agreement to be entered into with subdividers for extensions of water mains. This agreement appears to be the type of eontraet entered into where the Company performs the work. Because of certain difficulties encountered with the title company in the issuance of policies of title insurance upon pipe lines located in dedicated streets or alleys it will be necessary to revise the form of this agreement. With the changes which I shall suggest it will be satisfactory to show this form of agreement to prospective subdividers as a typical agreement which will be required when work is performed by the Company rather than the subdivider. I am not returning a copy of the contract with my approval because it is not our practice to approve blank copies of instruments. In ray letters to you of May 1 and May 28, 1953# I stated to you that the Company should obtain title reports or policies with respect to all new main extensions. I understand that Mr. Hammlll has discussed with you and Mr. Cory the type of report to be obtained where pipe lines are laid in dedicated streets and alleys as distinguished from pipe lines laid upon private easements. For your future guidance X suggest that you adopt the following practices} 1, Insist upon obtaining a private easement in all cases where the pipe lines are not laid in public streets and alleys. This would Include cases where subdivision maps show areas dedicated for public utility services, but which are not in fact dedicated streets and alleys.
