Stoddard) In connection with the proposed petition by Las Vegas Land & Water Company for an increase in rates, I wish you. would check the case referred to in an article on page $6 of the issue of Business Week, June 3 , 1950, under the heading Taxes and en­titled "Gifts are Depreciable, Too"; and also I suggest that this be called to Mr. Wehe's attention. I think this has a direct bearing on some of the matters we discussed at the conference in your office the latter part of May. After you have had a chance to review the case, I would be glqd to have your opinion, as well as that of Mr. Isaacs also on this. It appeals to me that this may also have an important bearing on the Railroad Company1s depreciation base since, at the present time the Bureau of Internal Revenue does not permit us to include in the base the cost or value of donated property which, in the case of the Union Pacific System runs into several million dollars.
