    *Pefenae M m l m .Rrolactai s Subject to the approval of the Rubllc Service Commission, the Company will enter Into contracts for the refund of the coat of eon©trueting water mains, advanced by others to end within defense Housing Projects, located in the present city Unite of the City of Las Vega®, ©evade, but with­in a distance from the Company's nearest existing water main, equal to not more than 20 feet multi­plied by the nunber of house® which such others agree with the Company to construct within such project. I Befen©e Housing Project within the meaning of this rule is a project under which the party con­tracting with the Company constructs within a sub­division, the plat of which has been filed with the County Recorder of Clark County, ©evade, not less than twenty \ W ) dwelling houses, but at least one dwelling house for each fifty (60) feet of such water mains constructed within such subdivision. Such contract shall provide that such water mains shall be constructed at the cost of the party con­tracting with the Company and under the supervision of the Company; that such water mains shall be owned, operated and maintained by the Company upon the completion of the construction thereof and that the Company shall refund to the party contracting with the Company the cost thereof if and when said party shall have completed the construction of the number of house® required by said contract, such contract may contain other reasonable provision® not incon­sistent with the other provisions of this rule. This rule shall remain in effect only during the present national Emergency.* 1 feel our Rule 9-A 1® equitable in the esse of a sub­division in which the subdivider develop® raw land by installa­tion of streets and public utilities and thereafter sell® lots upon which the purchaser may or may not construct improvement®, in which cast it may be several year© before any substantial number of water consumers are served by the main®, ©omelllni, however, contends, and I agree there l® merit to hi# argument, that in'the ease of a housing project in which a substantial number ©f homes are to be immediately constructed, the water Company will shortly after completion of the housing facilities receive substantial revenue from sale of water to consumers located in the tract, in view of which he should be refunded his costs upon completion of the project.
