December 21, 1951 Mr. louse?s letter to Mr. Stoddard relates to a let­ter which I wrote to Mr. Reinhardt on December 4, 1951» recommending that all interested departments give con** sideration to the advisibllity of transferring the wa­ter production facilities of the Railroad Company to the Las Vegas Land and Water Company and that the Las Vegas Land and Water Company dissassociate its -waiter production and distribution operations from all other operations. I find that I did not send you a copy of the letter and I do not have an extra copy to send you. However the reasoning was based upon the fact that it was possible the Railroad Company might be held to be a public utility at the present time because such a large part of its production was being sold to others, including the LVL&WCompany. I cited several cases in which wholesale distributors of water, gas and elec­tric power had been held to be public utilities. I also recommended it for the reason that it should help us in our rate troubles with the Public Service Com­mission. I should like to have your views on the questions raised by Mr. Rouse. E. E.
