THIS AGREEMENT, made and entered into as of the a _ — aay of y . 1954, by and between LAS VEGAS LAND AND WATER COMPANY, a corporation of the State of Nevada, hereinafter ealled “Company,” Party of the First Part, and BEN WEINGART, an indi­vidual, whose address is 1308 Shatto Street, Los Angeles 17, California, hereinafter called “Subdivider," Party of the Second Part, WITNESSETH: RECITALS WHEREAS, the Company is engaged in the business of dis­tributing water as a public utility, in the City of Las Vegas, Clark County, Nevada; and WHEREAS, the Subdivider is engaged in the development of Charleston Park Tract 2, Las Vegas, Nevada, and has made applica­tion for water service to serve said tract; and WHEREAS, the Company is willing to serve said tract with water, pursuant to its rules and regulations on file with the Public Service Commission of the State of Nevada; a g r e e m e n t ARTICLE I.
