\ 3 - Company to own said water mains; 4 - Subdivider to furnish Company necessary ease­ments for said pipe lines to be laid in other than dedicated streets and alleys, together with Bill-of-Sale, Title Guarantee and Policy of Title Insurance; 5 - Subdivider to obtain and furnish Company a re­lease from third parties who may participate in cost of installation of 8” water main in Oakey Blvd. and from owners of property im­mediately adjacent to Oakey Blvd. on north and south sides thereof, between Eastern Avenue and Southern Nevada Power Company right-of-way, releasing and relinquishing to Subdivider all right to refunds of revenue from customers of the Company immediately adjacent to Oakey Blvd., between the above described limits, and taking direct service from 8” water main to be constructed by Subdivider in Oakey Blvd.; be, and the same is hereby, ratified, approved and confirmed. On motion duly seconded, it was RESOLVED, that the action of Vice President Reinhardt and Secretary in executing Agreement ”NnL.D. 2770-3, dated February 8, 1954, between LVL&WCo., called '’Company”, and Ben Weingart, an individual, called "Subdivider”, providing? 1 - Subdivider, at his expense, to furnish all necessary materials and labor and constructs (a) Approximately 2,700 LF of 8” cast iron water mains; (b) Approximately 5,400 LF of 6” cast iron water mains; (c) Approximately 132 LF of 6” cast iron fire hydrant connections;. to serve Charleston Park Tract 2, Las Vegas, Nevada. 2 - Company to refund to Subdivider at quarterly intervals 35$ of revenue received by it from consumers located within said Subdivision and taking direct service from water mains so installed, including 35$ of revenue received from customers immediately adjacent to Oakey -3-
