1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 existence of said pipe lino# and polo lino# would substantially diminish the market value of the land# of Union Pacific in the vicinity of #aid pipe lino# and power line#, The parties agree that it would be impracticable or extremely difficult to determine the amount of the diminution in the market value of the aald lands of the Union Pacific which would result from the continued maintenance of said pipe lines and power lines in their existing location upon the said properties of Union Pacific which are not to be acquired by the District, It is desirable to both parties to have certain of said pipe lines and power lines removed from or relocated upon the proper ty of Union Pacific and to provide for the granting of easements to the District for it# pipe lines which will permanently occupy the property of Uhlon Pacific not acquired by the District. The parties also desire to agree upon the amount of liquidated damages which Union Pacific will be entitled to receive if certain of aald pipe lines and power lines are not relocated upon or removed from the property of the Union Pacific not to be acquired by the District, as required by the terms of this agreement. HOW THEREFORE, in consideration of the mutual covenants and agreements herein contained, it Is agreed as follows: Section It The District agrees that' it will, at its sole cost mid expense and within one year from the sale date, remove from the premises of the Union Pacific the following pipe lines and pole linesi - 2 -
