Motion seconded by Commissioner Moore and carried by the following vote: Commissioners Bunker, Moore, Peccole, Whipple and His Honor voting aye; noes, none. City Clerk ATTEST: APPROVED: Mayor Las Vegas, Nevada August 9, 1949 A recessed regular meeting of the Boar of Commissioners held this 9th day of August, 1949 was called to order at the hour of 3:35 P.M. by His Honor Mayor E.W. Cragin with the following members present: Commissioners Bunker, Moore, Peccole, Whipple; City Attorney Howard W. Cannon and City Clerk Shirley Ballinger. PUBLIC HEARING Commissioner Moore moved that a public hearing to determine whether or not rent in the Rent Decontrol Las Vegas area should be decontrolled be held August 23, 1949 at 8:00 P.M., and the necessary notices be published of this meeting. Motion seconded by Commissioner Peccole and carried by the following vote: Commissioners Bunker, Moore, Peccole, Whipple and His Honor voting aye; noes, none. SERVICE & MATERIAL Commissioner Whipple moved that Service & Material Warrant No. 1831 in the total amount WARRANT of $8,227.02 be approved and the Mayor and City Clerk authorized to sign same. Motion seconded by Commissioner Moore and carried by the following vote: Commissioners Bunker, Moore, Peccole, Whipple and His Honor voting aye; noes, none. RESOLUTION NO. 152 Commissioner Moore moved that the following resolution be adopted: Sales Agreement Sewage Facilities RESOLUTION WHEREAS, the sewage disposal plant, now owned and operated by the City of las Vegas, is inadequate for the needs of the said City, and the City has been required by the Nevada State Department of Health to provide for adequate sewage disposal facilities, and WHEREAS, the City has arranged to finance the construction of such new sewage disposal plant, and WHEREAS, the City has agreed to purchase from the United State of America and the United States of America has agreed to convey to the City that certain property con­sisting generally of a sewage disposal plant, pipes, pipelines, accessories and facili­ties for the conveyance of sewage, together with certain lands or interests in lands near the City described as any and all interest, easements, rights-of-way and land, then or thereafter acquired by the United States in the prosecution of project Nevada 26-116-F, together with all buildings, structures, and improvements constructed in, over, and upon said land, all facilities, equipment and appurtenances installed in or located on such lands, and interests in lands, and WHEREAS, a certain Sales Agreement has been proposed between the United States of America and the City of Las Vegas for the sale of said aforementioned property, a copy of which is attached hereto, NOW, THEREFORE, EE IT RESOLVED, by the Board of Commissioners of the City of Las Vegas, that that certain "Sales Agreement" be, and the same is hereby approved. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Mayor and City Clerk be and they are hereby authorized and directed to execute the said Sales Agreement. SALES AGREEMENT WHEREAS, the UNITED STATES OF America (hereinafter called the "Government") and the CITY OF LAS VEGAS, Nevada (hereinafter called the "City") entered into a certain Lease of War Public Works, dated July 1, 1946, covering certain property therein referred to consisting generally of a sewage disposal plant, pipes, pipelines, accessories, and facilities for the conveyance of sewage, together with certain lands or interests in lands in and near the City described as any and all interests, easements, right-of-way and land then or thereafter acquired by the Government in the prosecution of Project Nevada 26-116-F, together with all buildings, structures, and improvements constructed in, over and upon said land and all facilities, equipment and appurtenances installed in or lo­cated on such lands and interests in lands (all of such property, real or personal, being hereinafter called the "Property"); and WHEREAS, such Lease contained an option on favor of the City to purchase the Property on certain terms and conditions therein stated; and WHEREAS, the City on June 15, 1949, gave notice of the termination of said Lease effective December 31, 1949, because of the financial inability of the City to comply with its obligations under such Lease and to acquire the Property at the option price therein stated; and WHEREAS, the sewage disposal plant constituting a part of the Property is in­adequate for the needs of the City and the City has been required by the Nevada State Department of Health to provide adequate sewage disposal facilities, which facilities are estimated to cost approximately $55O,OOO; and WHEREAS, the City has arranged to finance the construction of such new sewage
