Therefore, the state engineer probably would reject an appli­cation to appropriate water in any of the land surrounding the fire forty acre parcels in the event that the Water Company should cell the balance of its land. However, there would be no protection to the water company if the state engineer would conclude that such pro­posed appropriations of water would not impair the value of existing rights, or be otherwise detemental to the public welfare. There is another Act which wae mended in 19% (7993 *11- 7993.21, HOE, 19*13-19% Supp) relative to the conservation and dis­tribution of underground waters and which would afford sons additional protection to the company in the foregoing situation* This Act gives extensive powers to the state engineer, prcrvided that the provisions of this Act are invoked by 15# or more of the owners of wells in any particular artesian basin. I am not advised as to whether this has ever been done in the las Vegas Artesian Basin, but it is my belief that the las Vegas Artesian Basin Is not now administered under the provisions of this Act.
