Commissioners Elwell, Fountain, Sharp and. His Honor, Mayor Gragson, voting aye; noes, none. Absent: Commissioner Whipple. Director of Public Works Sauer stated the plans, specifications and estimate of cost for street lighting between 6th Street and East Charleston Boulevard on Fremont, and proposed widening from 7th Street to 14th Street on Fremont have been filed with the City Clerk. Department of Public Works recommended that an Emergency Ordinance, creating an Assessment District and providing for a public hearing be prepared. Commissioner Fountain inquired what percentage of the property owners were in favor of the Assessment District. Director of Public Works Sauer advised that of the 86 property owners, 51.1% were in favor of the Assessment District, 10.5% were opposed, and 38.4% gave no reply; on the basis of front footage, 54.9% were in favor, 12.4% opposed, and 32.7% gave no reply. Mr. Sauer went on to say that at the time the Assessment District was first established it went from Charleston Boulevard to 6th Street on Fremont; however, the property owners between 6th and 7th Streets have no desire to be included in the Assessment District, and following the Public Hearing, which would be the next stop in the creation of this Assessment District, the Commission has authority to reduce the district from 7th Street to Charleston Boulevard for lighting, and from 7th to 14th Streets for widening. An Ordinance entitled: EMERGENCY ORDINANCE NO. 817 AN EMERGENCY ORDINANCE DECLARING THE DETERMINATION OF THE BOARD OF COMMISSIONERS OF THE CITY OF LAE VEGAS, NEVADA, TO MAKE CERTAIN PUBLIC IMPROVEMENTS IN SAID CITY BY INSTALLING STREET LIGHTING ON FREMONT STREET FROM SIXTH STREET TO THE INTERSECTION OF EAST CHARLESTON BOULEVARD AND STREET WIDENING ON FREMONT STREET FROM SEVENTH STREET TO FOURTEENTH STREET; TO CREATE STREET IMPROVEMENT ASSESSMENT DISTRICT NO. 100-28 FOR THE PURPOSE OF MAKING SAID IMPROVEMENTS; AND TO DEFRAY THE ENTIRE COSTS AND EXPENSE THEREOF BY SPECIAL ASSESSMENTS MADE ACCORDING TO FRONTAGE; FIXING A TIME IN WHICH PROTESTS AGAINST THE PROPOSED IMPROVEMENTS FOR THE CREATION OF SUCH DISTRICT MAY BE HEARD AND CONSIDERED BY SAID BOARD; DIRECTING NOTICE THEREOF TO BE GIVEN; PROVIDING OTHER MATTERS RELATING THERETO; AND DECLARING AN EMERGENCY, was read by title by City Attorney Cory, who stated that the time of the Public Hearing was fixed in the Ordinance for Wednesday, February 3rd, at 7:30 P.M., and that this would be published in the newspaper after the Ordinance is adopted. Commissioner Fountain moved the above-entitled Ordinance No. 817 be adopted. Motion seconded by Commissioner Elwell and carried by the following vote: Commissioners Elwell, Fountain, Sharp and His Honor, Mayor Gragson, voting aye; noes, none. Absent: Commissioner Whipple. The following Resolution was then read by City Attorney Cory: RESOLUTION WHEREAS, the Board of Commissioners of the City of Las Vegas, have taken steps to create certain public improvements, all as provided in Emergency Ordinance No. 817, passed, adopted and approved this 6th day of January, 1960; and WHEREAS, said Emergency Ordinance No. 817 discloses the intention and determination of said Board of Commissioners to create said district and construct said improvements by special assessment made according to frontage; and WHEREAS, said Emergency Ordinance No. 817 provides a time certain for hearing protests against said proposed improvements and directing the notice thereof to be given, such time of the protest hearing being 7:30 o'clock P.M., PST, on the 3rd day of February, 1960, NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Las Vegas at a regular meeting thereof held on the 6th day of January, 1960, that the City Clerk and the Clerk of the Board of Commissioners, be and she is hereby directed to publish notice of said hearing once a week for two successive weeks in the Las Vegas Review Journal, a daily newspaper published in the City of Las Vegas; and BE IT FURTHER RESOLVED that the City Clerk and Clerk of the Board of Commissioners be, and she is hereby directed to post notice of said hearing in at least three public places near the site of the proposed work; and BE IT FURTHER RESOLVED that the City Clerk and Clerk of the Board of Commissioners be, and she is hereby directed to mail a copy of said notice, postage prepaid, as first class mail, at least fifteen (15) days prior to said hearing, to the last known address of each last known owner of land in the district whose property will be assessed for the cost of the improvement, such addresses and owners being those appearing on the local property assessment rolls for general (ad valorem) taxes of the County of Clark, wherein said property is located; and 1-6-60 ASSESSMENT DISTRICT 100-28 Fremont St. Lighting and Widening Emergency Ordinance No. 817 Adopted RESOLUTION ADOPTED
