Cory: Under *8* L. 1. 1843 a water main was Installed by Frontier Improvement Company in the Sooth Fifth Street Tract and the Subdividers granted ns an easement 5 ~feet on each side of the common lot line between Lota 3 and 4 of Block 3# South Fifth Street Tract Mo. 1. This easement was duly recorded in Book 53, Page 547, of heeds, Clark County Records. Subsequently, and without notification to the Water Company, the plat was amended so that there are only 2 blocks In the tract Instead Of 3, and H o o k 3 was changed to read * H o o k 2*. The purchaser of Lot 4 has constructed an Auto Court, a portion of which encroaches on the pipe line easement. In view of the fact that the above mentioned agreement, C/A 10427, provides that the subdivider will furnish us an easement 5— feet on each side of the center line of pipe line so installed, assume that we could require them to do so. However, to avoid litigation and considerable expense, I have conferred with the parties concerned and the owners of Lot 4 agree to give us a 2 ft easement along the northerly edge of Lot 4, which is unoccupied by his building; and the Frontier Improvement Company will give us a 5 Ft easement along the southerly edge of Lot 3 . Will you kindly prepare 2 easements, one to cover a 2 ft strip along the northerly edge of Lot 4, to be executed by Clarence G. Flory and his wife Mae Flory; and a 5 ft easement along the southerly edge of Let 3, to be executed by Frontier Improvement Company. Both of these locations are in H o c k 2, South Fifth Street Tract, as shown on plat recorded in Book 2, Page 72, Clark County Records. When these easements are ready, If you will kindly send them to me X will have them executed by the parties concerned. A. M. Folger
