207 of the area over and above a public alley. Mr. Silvagni owns property on both sides of and abutting the alley at the easterly portion of Block 15, Clark's Las Vegas Townsite. On the above-mentioned date the Commission took this matter under advisement and ordered a study made with regard to the possibility of permitting such use. On January 27, 1948, the Planning Commission, upon report of the City Engineer, discussed and considered the various aspects of this problem and, Upon motion duly made and unanimously carried, recommends the following as the basis of permitting structural development over alley- ways, provided such procedure is first approved by the City Attorney as to compliance with any laws relative to permitting or prohibiting such use: 1. Lease-Rental Arrangement to be determined upon square foot basis for area covered, such charge being established in relation to appraised value of abutting property. 2. Legal Clearance required to be maintained above paved surface of alley. 3. Utilities and Public Facilities within, over, and above said alley to be properly rearranged with the approval of the utilities or operating agency concerned, and/or the City of Las Vegas. 4. Structural Development over and above alley area to be approved by the City of Las Vegas through the Building Department or other departments as deemed necessary. This recommendation is forwarded to your Honorable Board as a basis for such permits only, and is not to be construed as a recommendation that any such permits to be issued until the proper legal counsel has been secured and the plan established as a matter of policy by the Board of City Commissioners. It is possible that any permits, if granted for such use, be on the basis of a separate ordinance for each and every case. MARTIN TRACT Commissioner Clark moved that the final map of the re-subdivision of Final Map a part of the 14th Street City Addition, be approved as a condition relative to the vacation of 17th Street located between East Stewart and North Bruce Street and that the Mayor and City Clerk be authorized to sign said map when said vacation has been completed. Further, that the City Attorney be instructed to make said vacation in accordance with the recommendation of the Planning Commission. Motion seconded by Commissioner Baskin, and carried by the following vote: Commissioners Baskin, Clark, Moore, Whipple and His Honor voting aye. Noes, none. BOULDER DAM HOMESITE Commissioner Whipple moved that the final map of Boulder Dam Homsite Subdivision Map Tract subdivision Tract #5 be approved providing an agreement is entered into #5 covering improvements requested as appear in the minutes of September 22, 1947. Motion seconded by Commissioner Clark and carried by the following vote: Commissioners Baskin, Clark, Moore, Whipple and His Honor voting aye. Noes, none. ORDINANCE NO. 345. An Ordinance entitled "AN ORDINANCE TO REPEAL SECTION 25 AND TO AMEND First Reading SECTION 22, 26, and 27 of ORDINANCE NO. 331 OF THE CITY OF LAS VEGAS ENTITLED, 'AN ORDINANCE ESTABLISHING A PUBLIC POUND; PRESCRIBING THE POWERS AND DUTIES OF THE POUNDMASTER; FIXING THE FEES AND CHARGES TO BE COLLECTED BY HIM, AND DIRECTING THE DISPOSITION THEREOF; PROVIDING FOR THE REGISTRATION OF DOGS AND DOG KENNELS AND FIXING THE FEES THEREFOR; PROVIDING FOR THE VACCINATION OF DOGS AND CATS; PROVIDING FOR THE REDEMPTION, SALE OR OTHER DISPOSITION OF DOGS AND OTHER ANIMALS IMPOUNDED; PROHIBITING CRUELTY TO ANIMALS; PROVIDING A PENALTY FOR THE VIOLATION OF ANY OF THE PROVISIONS THEREOF; REPEALING ORDINANCES NOS. 5, 12, 19,51, 58, 63 and 101 and ALL ORDINANCES AND PARTS OF ORDINANCES OF THE CITY OF LAS VEGAS IN CONFLICT THEREWITH, AND OTHER MATTERS PROPERLY RELATING THERETO." was reported favorably by Commissioner Whipple and Moore and thereafter the foregoing ordinance was read to the Board in full for the first time.
