The said covenant restricting the drilling of water wells and the assignment of the Interests of Union Pacific therein have been made solely for the purpose of complying with the said proposed agreement with the District, and if the said sale to the District is not eventually consummated, it is the intention of the parties hereto to release Salt Lake Company from the obligations Imposed by said covenant restricting the drill ing of water wells. Agreement NOW, THEREFORE, IT IS AGREED by the parties hereto as follows t Section 1. Railroad Companies hereby grant to the Water Company license and permission to maintain, operate and renew the said power, telephone and telemeter lines shown by green lines, the said pipe lines shown by red and yellow lines and the pumping station shown at point HH on said Exhibit MAM and all appurtenances thereto upon, under, over and across the property of the Railroad Companies in their existing locations. Said license and permission is subject to all conditions, restrictions and encumbrances of record and to the rights of other persons in and to the lands of the Railroad Companies whether of record or not. Said license and permission is granted subject to the right of the Railroad Companies, their successors and assigns, to construct roadways, pipe lines and wire lines over and across the areas occupied by the said pipe lines and power, telephone and telemeter lines of the Water Company and subject to their right to use their property for any purpose whatso- 4.
