LAND AND WATER COMPANY, a corporation of the State of Nevada, hereinafter called "Company,tt Party of the First Part, and FEDERAL HOMES DEVELOPMENT CO., INC., a Nevada corporation, whose address is Room IQ Cornet Building, Las Vegas, Nevada, hereinafter called "Subdivider," Party of the Second Part, WITNESSETH: RECITALS WHEREAS, the Company is engaged in the business of dis­tributing water as a public utility, in the City of Las Vegas, Clark County, Nevada; and WHEREAS, the Subdivider is engaged in the development of Hyde Park Subdivision No. 2, Las Vegas, Nevada, as per map recorded in Book 3, Page 75 of Plats, Clark County Recorders Office, and has made application for water service to serve said tract; and WHEREAS, the Company is willing to serve said tract with water, pursuant to its rules and regulations on file with the Public Service Commission of the State of Nevada; AGREEMENT ARTICLE I .
