Attached hereto, marked Exhibit ”FM, and made a part hereof, is a legal description of the land to fee conveyed to the District for said pumping station aits. In t o event the District shall abandon the use of said pumping station on said land, the District at its sole expense, and within ninety (90) days after said abandonment, shall remove said pumping station and restore t o surface of the ground to the condition existing prior to the construction of said pushing station. Da or before t o sale date the District and Union Pacific shall enter into an agreement with the BANK OF NEVADA, of Las Vegas, Nevada, providing for the opening of a trust fund to fee held in trust fey said bank and disbursed pursuant to instructions given the Bank in said agreement for t o purposes hereinafter stated, on the first day of the month next succeeding t o sale date and on the first day of each month thereafter for a period of twenty (20) years, subject to the provisions of Sections 21 and 23 hereof, t o District shall deposit with t o said Bank in said trust fund t o sum of fwelve Hundred Fifty Dollars ($1,250.00),, 5 ^
