APPROVAL OF SENATE MINUTES 21-2sJT Senator Kostman moved to approve Senate Minutes Seconded by Senator Finmark. Call for a v o t e . Motion carried by voice vote, with Senators Ortega and Ricci abstaining. IV. ANNOUNCEMENTS Vice President Kevin Briggs announced that the slogan, "U.S.S. CSUN" to be painted on the new preschool playship has been approved. After the s p e c i f i c a t i o n s for the paint has been r e c e i v e d during this summer, Vice President Briggs would l i ke a l l the senators to pose for pictures with the playship, p o s s i b l y at the beginning of the semester. UNIVERSITY OF NEVADA, LAS VEGAS/4505 MARYLAND PARKWAY/LAS VEGAS, NEVADA 89154/(702) 739-3477 Senate Minutes 21-21 Page 2 05/30/91 Senate President Pro Tempore Bud Benneman mentioned that he was pleased with the senators getting together for caucus purposes both on-campus and off-campus and apologized to those senators who did not get called to attend these caucuses for whatever reasons (Romero, Ricci, Barkhuff). There will be more meetings and all will be contacted. Senate President Mike Kennedy was thankful for all senators who were present for helping to make quorum successful all summer, so far. Senate President Kennedy attributed this success to the fact that a lot of senators starting getting together on their own to interact on issues and getting quorum achieved. V. BOARD, COMMITTEE AND DIRECTOR REPORTS Senate President Kennedy asked for a report from the Senate Bylaws Committee. Senate Bylaws Committee Chairman Bud Benneman reported that the Bylaws Committee will start meeting on Wednesdays. The next meeting will be this Wednesday (06/04/91) at 12:30 p.m. He did not know the location since MSU is closed. He guessed that he would call the members of the Bylaws Committee and post an agenda tomorrow. Senate President asked for a report from the Senate Rules Committee. Senate Rules Committee Chairman Mike Bunin had no report. Senate President Kennedy stated that since there are no more boards, committees and directors as of the 15th of this month, that this item was easy. Senator Kershaw, "Point of information." Senate President Kennedy, "Senator Kershaw (state your point)." Senator Kershaw, "I thought that all boards were emptied as of the end of (the former Executive Board's) last term." Senate President Kennedy, "In the (CSUN) Constitution, it states that two weeks after the installation (of new E-Board members) all committees, even board members. Approval of Joel Kostman as Office of Student Information Director. Senator Finmark moved to approve item B under Executive Board Nominations. Senator Barkhuff seconded the motion. There was no discussion. Call for a vote. Motion carried by voice vote, with two abstentions (Kostman, Adair). C. Approval of Becky Jo Birmingham as Student Services Director. Senator Kershaw moved to approve item C under Executive Board Nominations. Senator Romero seconded the motion. Senator Bunin spoke against the motion and invited debate of the issue. Senator Kershaw, "Before this meeting, I had this (paper) dropped off at my seat, so I guess I'll read it (for Becky Jo Birmingham): I apologize for not being able to make this meeting, but I have two classes (5: 30-6: 40) ( 6 : 45-8 : 50) that are graded solely by attendance. If loyalty questions come up: My loyalty, as well as my respect, must be earned. This Executive Board has both. I have no doubts that through their continued HONEST dealings, my loyalty will be maintained and justified. There seems to have been questions as to my ability to competently handle both the Student Services Directorship and the Senate Secretary position. This stems from the fact that a previous Senate Secretary held a Directorship and mishandled time spent on both. The question, however, is not whether I am going to repeat performances of prior employees but whether I have proven myself in my work record. I am a good employee, and have never acted irresponsibly as Senate Secretary. I work extremely well under pressure, and can effectively perform duties of both positions. As far as conflicts are concerned, I will be in the office, on the time clock from 10am-5pm Tuesday through Friday, with an hour lunch, making it 30 hours per week as Senate Senate Minutes 21-21 Page 5 05/30/91 Secretary. On Thursdays, the hours will be extended to the adjournment of the Senate Meetings. On Mondays, I will be in 10am-4pm, due to a required class. As Director, office hours will be as follows: Monday, 6:30 p.m.-11 p.m.; Tuesdays, 7 a.m.-10 a.m.; Wednesdays, 5 p.m.- 11 p.m.; Thursdays, 7 p.m.-11 p.m.; Fridays, 7 a.m.-10 a.m. and 5 p.m.-8 p.m. I will be having specific hours for appointments with those who need or want to speak with me, as well as putting in weekend hours. During emergencies, I will be available as well, but off the clock as Senate Secretary. I will NOT be combining the two positions and get paid for doing Directorship duties while I work as Senate Secretary. I feel that I should be able to have a probationary period during the summer for three reasons: 1. Tie up some summer projects as Senate Secretary; 2. Enable me to prove I can efficiently handle both positions in a way that promotes both positions and Student Government as a whole; 3. If it does not work out, enable the Senate President to find a new Senate Secretary and have time to train him or her before the new semester (I would assist in training if necessary) . 11 Senator Bunin spoke against the motion. Senator Romero asked if it was possible for the Senate to look over the other applications for this position. Senate President Kennedy after conferring with President Colebrook, "No, we cannot (let the Senate look at the applications)." Senator Quick, "Can you clarify for the senators who are not aware, if we do not approve any one on this list, what is the process? And do you keep interviewing and keep submitting names? Can you clarify the process in case someone doesn't know, so that we don't feel that we have to vote today; if we turn someone down, it's not like a death situation or something?" President Colebrook, "It will be a death situation in terms of not getting somebody in there to do the job over the time period. We are now having a tough time getting meetings together to get things organized. But, first of all, let me just clearly state my support for all of these people that we have here under the Executive Board Nominations. We have chosen Senate Minutes 21-21 Page 6 05/30/91 these people because we feel that they are the best people for the position. We went through the interview process; we tried our best; and we came up with the people who we thought could really do (the job). We had to throw out a lot of things, a lot of personal things. A lot of things, you know, even if we didn't like somebody, we had to (ask ourselves), 'Is this in the best interest of the students?' We said (those words) during consideration. We made that choice. We threw out those personal things and came up with those decisions, and I think we came up with the best ones. It isn't as if we went in there saying 'Hey, we want to get our friends in there; we want to get somebody who likes us in there, who cares about us, who wants to do things just for us.' No, we didn't even try to do that. We tried to do the best as the Executive Board. We looked, we listened, we heard, and we came up with these people. I think Becky Jo Birmingham will do a really good job in there. And in terms of her holding onto the (senate) secretary position, no, she won't be a secretary and also a (director) . She was asking whether or not she could do it. I told her today that, no, she can't, whether or not the senate approves it. So, she'll be just a director, and not a secretary." Senator Benneman, "Point of information." Senate President Kennedy, "Yes (state your point)." Senator Benneman, "Just to clarify Senator Quick's point here, the question is 'What happens if we do not approve "Jane Smith" in any of these positions?' It just goes back into the nomination process, comes back up into the next senate meeting, and it's done again." Senate President Kennedy recognized Vice President Briggs. Vice President Briggs, "Just also as a point of information, according to the (CSUN) constitution, there is a time constraint on getting a budget submitted, and those directors are responsible for submitting budgets. That time constraint is like the second week in June, if I'm not mistaken." Senate President Kennedy recognized Senator Bunin. Senator Bunin, "As a point of information, I hope to Gawd we don't hire directors just because we have a budget to submit soon." Senator Finmark called for the question. Senator Bunin objected, then made a friendly amendment, and called for a roll call vote. D. Approval of Kim Kershaw as Elections Board Director. Senator Kostman moved to approve item C under Executive Board Nominations. Senator Finmark seconded the motion. Senate President Kennedy recognized Senator Quick. Senator Quick, "Just seriously, do we lose a senator over this I saw the payment for the month(s) here (under New Business). Kim does her job here on the Senate and that, so are we going to lose her in October before the Senate ends? So (she) will have to step down? I want to know. .. because it's kind of... I mean, if (she'd) rather be on the...do the Elections thing than the Senate, then that's...I just want to make sure." Senate President Kennedy, "She cannot receive any remuneration as long as she's a senator. And when she resigns, she's still a senator, but she cannot collect any of the money even though she has a contract approved. And when she resigns she gets the money at that point. But she can't collect until (she's no longer a senator in) October." Call for a vote. Motion carried by voice vote, with one opposed (Adair) and one abstention (Kershaw). Senator Maultsby motioned to move out of the order of the day to Executive Board Nominations items L, M, and N. Senator Quick seconded the motion. Approval of Christian Hardigree as Entertainment and Programming Director. President Colebrook moved to approve item E under Executive Board Nominations. Senator Kershaw seconded the motion. Senate President Kennedy recognized Senator Kershaw. Senator Kershaw stated a point of information on item M under Executive Board Nominations that the dates "June 1, 1991 through May 31, 1991" should read "June 1, 1991 through May 31, 1992". Senator Benneman moved to reconsider item M under Executive Board Nominations. Senator Ortega seconded the motion. Senate President Kennedy recognized Senator Benneman. Senator Benneman, "To reconsider item M: We'll leave it exactly as it is, except for it saying 1991 (at the end of the item) , it'll (read) 1992." Motion to approve item M under Executive Board Nominations with the correction of May 31, 1991 to May 31, 1992 carried by voice vote, with one abstention (Ortega). Senate Minutes 21-21 Page 9 05/30/91 Senate President Kennedy, "Back into item E under Executive Board Nominations: Approval of Christian Hardigree as Entertainment and Programming Director. Is there a motion to approve?" Unknown, "There's a motion already on the floor." Senate President Kennedy, "Okay, moved to approve by President Colebrook, seconded by Senator Kershaw. Is there any discussion?" Senator Bunin spoke against the motion. Senator Finmark called for a roll call vote. There was no second. Senate President Kennedy recognized President Colebrook. President Colebrook, "Okay, think about (this) now. Look, a lot of people don't like what happened in the past. There is no doubt about it. A lot of people's toes got stepped on; a lot of people don't like what happened; people are upset about it. And obviously, a lot of you senators will be pressured into not going certain ways. And if you do go against the "system", you might say, or those who might be in a little bit of power, you might get stepped on, you might get ostracized, maybe you will get hurt or something. But, let's look at this in terms of doing what's right again. Maybe you're not interested, maybe you just don't want this particular person in here. Maybe you just want to say 'hey, she hates Student Government. She don't care; she steps on people, or so forth. Let's just kick her, she's tried to kick us before. Let's kick her now. Let's get back at her. This is one way we can really get back at her.' And most likely that's what will happen. (But) let's go beyond that. Let us be a little bigger than that. Let us give someone a chance to go all out and do something for the students, someone who cares about them. We cannot say that this person does not care about Student Government, or the student themselves just because she ran in the (Executive Board) elections. (We can't say) that she doesn't care what's going on with the students even though a lot of things happened (during the elections) out there. We can't just stand on the side• and say that because other people are going against her that we (must vote against her). Let's think of the students. Let's think of the (larger issue). When we went into the (interview) and we discussed this issue, we went back and forth on this. We really thought about who would do the best job. I think that Christian Hardigree has what it takes to do a really great job, and she can make Student Government much better, not Senate Minutes 21-21 Page 10 05/30/91 just Student Government, but E & P much better than it was. That's it." Senate President Kennedy recognized Senator Bunin. Senator Bunin, "I've got a few things to say. The first thing to say is that the meeting (caucus) we just had, nobody was ostracized, nobody was threatened in any way, no ramifications are going to happen to which a vote was labeled, so I think that was a statement in poor judgment." President Colebrook, "I really don't think so," Senator Bunin, "I know you don't, otherwise you wouldn't have said it. Please, I have the floor. I really think it was poor to say, in my opinion. You know, the senate has to do a job, and lot of times tough decisions come up. We have to represent our constituents properly. I didn't agree with a few of the names that were up here, okay? And in order to represent my constituents properly, I have to lobby the senate, senators, excuse me, and that's what I did. I just want to clarify, I mean, there was no...was anybody's arm twisted when we went in for dis cussion? Okay, Kim Kershaw was beat up, that was the one person (unintelligible due to laughter) . I really think that was a poor statement to make, and I think it undermines the Senate. (Senate President Pro Tempore Benneman: "Let's stop the cross-debate!") I'm not cross-debating! (Senate President Kennedy: "Senator Bunin has the floor!") Again, think about weighing the arguments and do what you have to do in your heart. You know, you have to make a decision not just for yourself but for the people you represent in your colleges. And it doesn't come down to personal (feelings) and whether somebody dislikes somebody, whether somebody said something about somebody. It comes down to legitimate, intelligent reasoning, intelligent arguments which will register (unintelligible) that little recess we just had. I'll just leave it at that." Senate President Kennedy recognized Vice President Briggs. Vice President Briggs, "To be honest with you, before we started these interviews, when I saw Christian's name, I looked at that and I thought because of the things that have happened during the elections, there's no way that I could nominate her for the position that she was applying for. However, in the interview process, she was able to sell me on the programs and the ideas that she had. I think, for you, it's only fair for you to hear some of those ideas, and I think it would be a great idea to...can I yield the floor to Christian?" Senate President Kennedy, "I'm not too big on that (right now)." Senate Minutes 21-21 Page 11 05/30/91 Senator Bunin, "I'll object to it." Senator Kostman, "I'll object to it." Senate President Pro Tempore Benneman, "I'll object to it." Senator Finmark, "I'll object to it, too." Vice President Briggs, "I think it's only fair for you guys to hear some of the ideas that she has." Senator Finmark, "Point of information. We received a proposal in our boxes." Senate President Kennedy recognized Senator Finmark after the fact. Senate President Kennedy recognized Senator Quick. Senator Quick, "I think she oughta get up and speak. Dammit, we're here choosing a director. No matter what the popular opinion is, let her just get up and speak! Damn it! Senate President Kennedy, "Are you yielding the floor to ... " Senator Quick, "Yeah, I'm yielding the floor. Any problems? No, I don't think so. Thank you. Stand up and speak! Senator Bunin, "Yeah, I object!" Senator Quick, "No!" Senate President Pro Tempore Benneman, "There's an objection." Senate President Kennedy, "There's an objection. There must be a vote on the objection. Senator Bunin, are you objecting?" Senator Bunin, "Senate President, if she's allowed to speak, am I allowed to ask questions?" Senate President Kennedy, "Yes, you are." Senator Bunin, "Give her the floor." Senate President Kennedy, "Are you withdrawing your objection?" Senator Bunin, "Yeah, I withdraw my objection." Senator Quick yielded the floor to Christian Hardigree. Senate Minutes 21-21 Page 12 05/30/91 Christian Hardigree, "Thank you, I realize that there's a (certain amount) of controversy over this. The reason the proposals were in your boxes were just to give you an base of what's going on. I agree with what Mike says. This is nothing personal, you are doing what is best for your constituents. And you won't find a person on this campus whose programs are diverse and better than (what) I can (do). All the stuff that's on the program council, the numbers that you see on that sheet of paper, that was done for less than fifteen thousand dollars. Less than fifteen thousand dollars. I can program an entire year here for sixty thousand dollars. And you're not going to find that someone else. You're not going to find the people that know the contacts that you need to make. (One of my) proposals is for Sha-Na-Na. I've met the group. Their going price is ten to twelve thousand dollars on the Strip. I can get them for while they're here in town, and it says five thousand dollars, I can put money on it that I can get them for at least three, or at most, three (thousand dollars) because I've met them and I know them. And I didn't put that on the proposal because I can't guarantee that because I can't call them up and say 'I'll book you' because I don't have this position yet. The proposal for different things to have, the balloons and what not. That's just to show you, we need things in stock. We don't need to go to Discount Party Shop and buy balloons at the last minute, because that's a waste of money. You can order through catalogs. Professional companies that (cater exclusively for) parties. There's murals that they have for dances. This is what these companies do, they do this for a living. And if you order from those companies, you save twenty to fifty dollars here and there, and that adds up. And that's the money you save so you don't blow six grand on a comedian and have two hundred people show up in the courtyard. That's not appropriate. You don't get to the other side of campus, and that's something that we need to do. We can have picnics for the football games and dances and different things like that over here, and let the fine arts department know what's going on, and let the athletic teams know. They don't know that Student Government is even around. Coach Strong is very much into having his football players and what not involved in their Student Government, but they don't know or care what's going on. No one bothers to go to Rebel Park one afternoon and have a barbeque with them, or to say that 'you people are giving part of your time.' That's six hours a day to practice and perform, and when you're in a game, you're going all day long. And those people are not being told by their Student Government that you're special to us, you're giving up your time to represent our school. And that Student Government's job. Along with OSI, E&P is the liaison to the students, they don't care whose running it. They see it as Student Government, whether it's the Executive Board, the Senate, whoever. Those are the people who Senate Minutes 21-21 Page 13 05/30/91 program whatever events we need. The calendar that's there is not all (complete). I think it's way underprogrammed. And there needs to be more stuff on the rest of the campus. But it's some ideas to let you know what I want to do. We need to get over here. I've lived in the Residence Halls, as did Wendy, as she knows, that they're completely under-entertained. They're not programmed for it. We need lectures.
