Lag Vegas - February 3, 1945 W 15-1-9 Ur. Fiank Strong: Your memo January 31, File 085, requesting state- < raent showing cost to conform with Fair Labor Standards Act of 1938. I a® not entirely clear on the provisions of the Act which would be used as a basis for ©©©piling the statement you request. As this Information will cover more than a six-year period I feel we should establish specifically what information is required before commencing the search. It was my impression, as indicated in my letter to you June 8, 1944, that the principal portions of the Act affecting us were the establishment of a minimum wage of Thirty (30) cents per hour, bases on a maximum of 40 hours work per week with time and & half thereafter; and that inasmuch as our minimum wage was well in excess of that we were observing the Act. However in conference with Mr. LcMamee today I understand all work in excess of 40 hours per seek must be paid for at time and a half of the then prevailing wage scale regardless of what that rate might have been; and further,. because we have not previously observed this provision we must now pay double time instead. X submit a sample of the statement I propose to compile under this understanding and will be glad to have you confer with Hr. Bennett arks advise whether it will cover our requirements.
