Robertson: Referring to your le tte r of June 4th, your f i l e H-IO-65- I , regarding the regulations of the C aliforn ia Department of Weight and Measure relatin g to the sale of potatoes in sacks: The C alifornia Department of Weight and Measure has no ju risdiction to regulate the weight per sack of potatoes sold by the sack without the State of C alifornia. The C alifornia Act is designed to regulate only the local sale of potatoes by sack. Through contact with the local officfe of the Department of Weight and Measure, I learned that the State Authorities do not assume to regulate the sale of potatoes by sack in outside states, nor do they attempt to regulate the movement of potatoes from an outside state into this sta te . ; - V '1 ? With reference to the third quoted paragraph to which you re fe r, I learned that the ^ocal authorities, when they discover that potatoes have been received in this state in sacks weighing more or less than one hundred pounds, attempt to get in touch with ou t-of-state authorities and have the sack-weight changed to conform with our local requirements. This is not done in an assumption of ju r is ­diction over the sale of potatoes in other states, but simply to fa c ilita te the resale of such potatoes by the. local consignees. June 1 2 , 1931.
