I have gone over the draft of agreement carefully and take the liberty of suggesting some changes in addition to those suggested by Mr* Jeffers. I have written a redraft incorporating these suggested changes which I comment upon as follows: (1) I do not feel that the draft as prepared clearly sets forth our intent in the construction of connection and meter to serve the Industry. It is my understanding that the Railroad Company intends to install,at the expense of the Industry, a connection between the Railroad Companyrs water main and the Industry's lease line and to install upon this connection a meter* This connection, including the meter which, in the redraft, I have designated as "User's connection", is, in the redraft, definitely defined in location as between the Railroad Company’s main and the Industryrs property line* (2) In Mr* Adamson's letter, to you, of April 5th, file 27-2-1, he suggests that provision be made that Railroad maintain the entire pipe line at the sole cost of the User. I discussed this feature in detail with Mr* Adamson this morning and he agrees that it would be best to place the obligation for maintenance of any and all lines upon the leased premises upon the User. If we assume obligation for maintenance of service lines on leased premises, our water service men will be subject to emergency calls and, if engaged in more urgent Railroad work, we are of the opinion that a break and consequent prolonged leak in the User's line would bring about contention on the part of the User in paying monthly bill. Further, we do not feel that our maintenance forces should have this added obligation. Maintenance of service lines on private property is, in the cases of public utilities, invariably up to the User. I have incorporated an extra paragraph to bring out this obligation on the part of the User as well as obligation of User to construct its service lines vpon leased premises.
